Wells, AICP, <br />Community Development Director <br />95 Triplet Lake Drive <br />Casselberry, FL 32707 <br /> <br />ORDINANCE # 03-1093 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE <br />CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE <br />OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE <br />DESIGNATION OF OFFICE.RESIDENTIAL (OR) FOR THAT PARCEL DESCRIBED <br />IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE. <br /> <br />Whereas, the property described in Section I was annexed into the City of Casselberry on June 11, <br />2003; and <br /> <br />Whereas, a Public Hearing on the question of amending the Seminole County Office future land use <br />designation of the property hereinafter described, has been duly held in the City of Casselberry, Florida and <br />at such hearing, interested parties and citizens for and/or against the proposed establishment of the City of <br />Casselberry Office-Residential future land use designation were heard; and <br /> <br />Whereas, the Casselberry Planning and Zoning Commission/Land Planning Agency has held a public <br />hearing with due public notice to consider the comprehensive plan amendment; and <br /> <br />Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held <br />a public hearing to consider the comprehensive plan amendment and has determined that the Future Land <br />Use designation of said property shall be established as Office-Residential as that designation is defined in <br />Future Land Use Element Policies FLU 1.5, as amended and supplemented, of the Comprehensive Plan of <br />the City of Casselberry, Florida; and <br /> <br />Whereas, such amendments are permitted subject to the provisions of F.S. Chapter 163, and FAC <br />Rule 9J-11. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and <br />supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, <br />regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same <br />is hereby amended to include property as Office-Residential, for that parcel of land located at 2904 <br />Lakeview Drive, as requested by the owner of said land described as: <br /> <br />LEG BEG SE COR LOT 5 RUN W ON PINE ST 75 FT NEL Y TO N LINE LOT 5 TO PT 80 FT W OF NE <br />COR SEL Y ON LOT LINE TO NE COR SW TO BEG BLK A REPLAT OF BLK C SOUTH FERN PARK <br />SUBD PB 7 PG 81 <br /> <br />Ordinance 03-1093 <br />Page 1 <br />
