Wells, AICP, Community Development Director 95 Triplet Lake Drive Casselberry, FL 32707 ORDINANCE II 02-1074 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION OF COMMERCIAL (C) FOR THAT PARCEL DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. Whereas, a Public Hearing on the question of amending the Seminole County commercial future land use designation of the property hereinafter described, has been duly held in the City of Casselberry, Florida and at such hearing, interested parties and citizens for and/or against the proposed establishment of the City of Casselberry commercial future land use designation were heard; Whereas, the Casselberry Planning and Zoning Commission/Land Planning Agency has held a public hearing with due public notice to consider the comprehensive plan amendment; Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held a public hearing to consider the comprehensive plan amendment and has determined that the Future Land Use designation of said property shall be established as Commercial as that designation is defined in Future Land Use Element Policies FLU 1.8, as amended and supplemented, of the Comprehensive Plan of the City of Casselberry, Florida; and Whereas, such amendments are permitted subject to the provisions of F.S. Chapter 163, and FAC Rule 9J-l1. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That Chapter 66, Section 66.29 of the City of Casselberry Code, as amended and supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same is hereby amended to include property as Commercial, for that parcel of land located west of SR 436 and south of Casselton Drive extended, as requested by the owner of said land described as: LEG SEC 34 TWP 21S RGE 30E BEG 939.14 FT S 2 DEG 28 MIN 41 SEC E OF NW COR OF SW 1/4 OF SW 1/4 RUN N 88 DEG 3 MIN 35 SEC E 511.06 FT S 23 DEG 54 MIN 25 SEC E 414.77 FT S 88 DEG 3 MIN 35 SEC W 662.61 FT N 2 DEG 28 MIN 41 SEC W 384.72 FT TO BEG (5.1826 AC) Ordinance No. 02-1074 Page 1
