Wells, AICP, <br />Community Development Director <br />95 Triplet Lake Drive <br />Casselberry, FL 32707 <br /> <br />ORDINANCE it 02.1061 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY <br />OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE <br />LAND USE MAP BY ESTABLISHING THE FUTURE LAND USE DESIGNATION OF <br />SEMINOLA BOULEVARD OVERLAY DISTRICT, PHASES I AND II, FOR THOSE <br />PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br /> <br />Whereas, a Public Hearing on the question of establishing a future land use designation of the <br />property hereinafter described has been duly held in the City of Casselberry, Florida and at such hearing, <br />interested parties and citizens for and/or against the proposed establishment of the future land use <br />designation were heard; <br /> <br />Whereas, the Casselberry Planning and Zoning Commission/Land Planning Agency has held a public <br />hearing with due public notice to consider the comprehensive plan amendment; <br /> <br />Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held <br />a public hearing to consider the comprehensive plan amendment, and <br /> <br />Whereas, such amendments are permitted subject to the provisions of Chapter 163, F.S. and Rule <br />9J.11, FAC. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and <br />supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, <br />regulating and restricting the use of lands located within the City of Casselberry, Florida, is hereby <br />amended by this amendment to include property as Seminola Boulevard Overlay District, Phases I and II of <br />said land described in Exhibit I, and is hereby amended and given the Seminola Boulevard Overlay District, <br />Phase I and II Future Land Use designation. <br /> <br />SECTION II. Conflicts. All Ordinances or parts of Ordinances in conflict with any of the provisions of <br />this Ordinance are hereby repealed. <br /> <br />SECTION III. Severabllitv. If any Section or portion of a Section of this Ordinance proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of <br />any other Section or part of this Ordinance. <br /> <br />Ordinance No. 02-1061 <br />Page 1 <br />
