<br />ORDINANCE # 01-1040 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY <br />OF CASSELBERRY, FLORIDA UNIFIED LAND DEVELOPMENT REGULATIONS <br />TABLE 2-5.3, ALLOWABLE USES, AS ESTABLISHED IN ARTICLE V, SECTION 2-5.2, AS <br />AMENDED AND SUPPLEMENTED; ALLOWING AS A CONDITIONAL USE <br />VETERINARY MEDICAL SERVICES AND PET GROOMING SERVICES IN THE PMX-H <br />ZONING DISTRICT WHEN NO RESIDENTIAL COMPONENT IS PRESENT; AND <br />ALLOWING AS A CONDITIONAL USE FUEL STORAGE AND DISPENSING IN THE PS <br />ZONING DISTRICT; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION <br />AND AN EFFECTIVE DATE. <br /> <br />Whereas, a Public Hearing on the question of establishing zoning classification of the <br />property hereinafter described has been duly held in the City of Casselberry, Florida and at such <br />hearing, interested parties and citizens for and/or against the proposed establishment of zoning <br />classification were heard; and <br /> <br />Whereas, fuel storage and dispensing is a necessary function to provide efficient and cost <br />effective services to the citizens of Casselberry, Florida, especially in times of emergency; and <br /> <br />Whereas, veterinary medical and pet grooming services are common and necessary services <br />provided in commercial areas; and <br /> <br />Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, <br />has determined these uses shall be allowed as conditional uses to mitigate any negative impacts to the <br />community and shall be included in Table 2-5.3, Allowable Uses, in Article V of Chapter II, as <br />amended and supplemented, of the Unified Land Development Regulations, Code of Ordinances of <br />the City of Casselberry, Florida, and <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That the Table 2-5.3 established in Article V Section 2-5.3 of the Unified Land <br />Development Regulations of the Code of Ordinances of the City of Casselberry, Florida, as amended <br />and supplemented, is hereby amended to allow veterinary medical services and pet grooming services <br />as a conditional use in the PMX-H zoning district when no residential component is present, and fuel <br />storage and dispensing as a conditional use in the PS zoning district as shown Attachment I. <br /> <br />SECTION II. Conflicts. All Ordinances or parts of Ordinances in conflict with any of the <br />provisions of this Ordinance are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Ordinance proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Ordinance. <br /> <br />SECTION IV. Codification. It is the intention of the City Commission of the City of <br />Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and <br />be made a part ofthe City of Casselberry, Florida; adopted zoning map. <br /> <br />SECTION V.
