ORDINANCE # 01-1035 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN ARTICLE IV, SECTION 2- 4.3, UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; ESTABLISHING THE ZONING CLASSIFICATION OF COMMERCIAL GENERAL (CG) FOR THAT PARCEL DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. Whereas, a Public Hearing on the question of establishing zoning classification of the property hereinafter described has been duly held in the City of Casselberry, Florida and at such hearing, interested parties and citizens for and/or against the proposed establishment of zoning classification were heard; and Whereas, the property hereinafter described is designated as Commercial (C) on the Casselberry Comprehensive Plan Future Land Use Map; and Whereas, the CG zoning classification is consistent with the Commercial Future Land Use Map designation; and Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has determined that the zoning classification of said property shall be established as Commercial General (CG) as that classification is defined in Articles IV and V of Chapter II, as amended and supplemented, of the Unified Land Development Regulations, Code of Ordinances of the City of Casselberry, Florida, and NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That the Official Zoning Map established in Article IV Section 2-4.3 of the Unified Land Development Regulations of the Code of Ordinances of the City of Casselberry, Florida, as amended and supplemented, for those parcels ofIand located on 6400 S. Hwy 17-92, more specifically described as follows: LEG SLY 50 FT OF LOT 5 + ALL LOT 6 (LESS SLY 71.3 FT) BLK A SOUTH FERN PARK SUBD PB 7 PG 61 and is hereby amended and given the zoning district classification as follows: Commercial General (CG) as that classification is defined in Articles IV and V of Chapter II, as amended and supplemented, of the Unified Land Development Regulations, Code of Ordinances of the City of Casselberry, Florida. SECTION II. Conflicts. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION IV. Codification. It is the intention of the City Commission of the City of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the City of Casselberry, Florida; adopted zoning map. SECTION V. Effective Date. This Ordinance shall become effective immediately following the effective date of Ordinance 01-1032. Ordinance #01-1035 Page 1 0[2
