<br />ORDINANCE # 01-1029 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND <br />USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION OF COMMERCIAL (C) <br />AND TO AMEND THE CITY OF CASSELBERRY OFFICIAL ZONING MAP, BY AMENDING <br />THE OFFICIAL ZONING MAP ESTABLISHING THE ZONING CLASSIFICATION OF CS <br />(COMMERCIAL SERVICES) FOR THAT PARCEL DESCRIBED IN SECTIONS I AND II OF <br />THIS ORDINANCE; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND <br />AN EFFECTIVE DATE. <br /> <br />Whereas, a Public Hearing on the question of establishing a future land use designation and zoning <br />of the property hereinafter described has been duly held in the City of Casselberry, Florida and at such <br />hearing, interested parties and citizens for and/or against the proposed establishment of the future land use <br />designation were heard; <br /> <br />Whereas, the Casselberry Planning and Zoning Commission/Land Planning Agency has held a <br />public hearing with due public notice to consider the comprehensive plan amendment and rezoning; <br /> <br />Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has <br />held a public hearing to consider the comprehensive plan amendment and rezoning and has detennined <br />that the Future Land Use designation of said property shall be established as Commercial as that <br />designation is defined in Future Land Use Element Policy FLU 1.8 as amended and supplemented, of <br />Comprehensive Plan of the City of Casselberry, Florida, and is hereby given the zoning district <br />classification of CS (Commercial Services) as that classification is defined in Articles IV and V of <br />Chapter II, as amended and supplemented, of the Unified Land Development Regulations, Code of <br />Ordinances of the City of Casselberry, Florida. <br /> <br />Whereas, such amendments are pennitted subject to the provisions of Chapter 163, F.S. and Rule <br />9J-ll, F.A.C. and Part II, Section 2-4.3 of the Unified Land Development Regulations. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and <br />supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, <br />regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same <br />is hereby amended by this amendment LPA 01-10 to: Amend the Official Future Land Use Map to <br />include property as Commercial as requested by the owner of said land described as. <br /> <br />Lot 4E: W 425 FT OF LOT 4 (LESS N 400 FT) I ST ADD TO CASSELBERRY PB 7 PG 30 <br />Lot 4G: LOT 4 (LESS N 400 FT & W 425 FT) I ST ADD TO CASSELBERRY PB 7 PG 30 <br /> <br />SECTION II. That the Official Zoning Map established in Article IV Section 2-4.3 of the Unified <br />Land Development Regulations of the Code of Ordinances of the City of Casselberry, Florida, as <br />amended and supplemented, for those parcels of land specifically described as follows: <br /> <br />Lot 4E: W 425 FT OF LOT 4 (LESS N 400 FT) I ST ADD TO CASSELBERRY PB 7 PG 30 <br />Lot 4G: LOT 4 (LESS N 400 FT & W 425 FT) 1ST ADD TO CASSELBERRY PB 7 PG 30 <br /> <br />Ordinance # 01-1029 <br /> <br />Page 1 of2 <br />
