<br />ORDINANCE # 01-1020 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND <br />USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION OF COMMERCIAL (C) <br />FOR THAT PARCEL DESCRffiED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br /> <br />Whereas, a Public Hearing on the question of establishing a future land use designation of the <br />property hereinafter described has been duly held in the City of Casselberry, Florida and at such hearing, <br />interested parties and citizens for and/or against the proposed establislunent of the future land use <br />designation were heard; <br /> <br />Whereas, the Casselberry Planning and Zoning Commission/Land Planning Agency has held a <br />public hearing with due public notice to consider the comprehensive plan amendment; <br /> <br />Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has <br />held a public hearing to consider the comprehensive plan amendment and has detennined that the Future <br />Land Use designation of said property shall be established as Commercial as that designation is defined in <br />Future Land Use Element Policy FLU 1.8 as amended and supplemented, of Comprehensive Plan of the <br />City of Casselberry, Florida, and <br /> <br />Whereas, such amendments are permitted subject to the provisions of Chapter 163, F.S. and Rule <br />9J-l1, F.A.C. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and <br />supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, <br />regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same <br />is hereby amended by this amendment LPA 01-02 to: Amend the Official Future Land Use Map to <br />include property as Commercial as requested by the owner of said land described as: <br /> <br />LEG SEC 34 TWP 21S RGE 30E SW 1/4 OF SW 1/4 W OF ST RD 436 (LESS N 560.52 FT & S 384.72 <br />FT)(3.79 AC) <br /> <br />SECTION II. Codification. It is the intention of the City Commission of the City of Casselberry, <br />Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of <br />the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this Ordinance may be <br />renumbered or re-Iettered to accomplish such intention; that the word, "Ordinance" may be changed to <br />"Section," "Article," or other appropriate word. <br /> <br />SECTION III. Conflicts. AIl Ordinances or parts of Ordinances in conflict with any of the <br />provisions of this Ordinance are hereby repealed. <br /> <br />SECTION IV. Severabilitv. If any Section or portion of a Section of this Ordinance proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or <br />effect of any other Section or part of this Ordinance. <br /> <br />Ordinance # 01-1008 <br /> <br />Page 10[2 <br />
