<br />ORDINANCE # 01-1008 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY <br />OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE <br />LAND USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION OF <br />MEDIUM DENSITY RESIDENTIAL (MDR) FOR THAT PARCEL DESCRIBED IN <br />SECTION I OF THIS ORDINANCE; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE. <br /> <br />Whereas, a Public Hearing on the question of establishing a future land use designation of the <br />property hereinafter described has been duly held in the City of Casselberry, Florida and at such <br />hearing, interested parties and citizens for and/or against the proposed establishment of the future <br />land use designation were heard; <br /> <br />Whereas, the Casselberry Planning and Zoning CommissionlLand Planning Agency has held a <br />public hearing with due public notice to consider the comprehensive plan amendment; <br /> <br />Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, <br />has held a public hearing to consider the comprehensive plan amendment and has determined that the <br />Future Land Use designation of said property shall be established as Medium Density Residential as <br />that designation is defined in Future Land Use Element Policy FLU 1.2 as amended and <br />supplemented, of Comprehensive Plan of the City of Casselberry, Florida, and <br /> <br />Whereas, such amendments are permitted subject to the provisions of Chapter 163, F.S. and <br />Rule 9J-II, FAC. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and <br />supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, <br />regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the <br />same is hereby amended by this amendment LPA 01-01 to: Amend the Official Future Land Use Map <br />to include property as Medium Density Residential as requested by the owner of said land described <br />as: <br /> <br />LEO SEC 28 TWP 21S ROE 30E N 1/4 OF S 1/2 OF NE 1/4 OF SW~, less the road R/W for Lake <br />Howell Road, together with; LEO SEC 28 TWP 21S ROE 30E S 1/4 OF N 1/2 OF NE 1/4 OF SW ~, <br />less the road R/W for Lake Howell Road, Seminole County, FL <br /> <br />SECTION II. Codification. It is the intention of the City Commission of the City of <br />Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and <br />be made a part of the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this <br />Ordinance may be renumbered or re-Iettered to accomplish such intention; that the word, "Ordinance" <br />may be changed to "Section," "Article," or other appropriate word. <br /> <br />Ord. 01-1008: Page I <br />
