<br />ORDINANCE # 00-997 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY <br />OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL <br />FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION <br />OF MDR (MEDIUM DENSITY RESIDENTIAL) FOR TIIAT PARCEL DESCRIBED IN <br />SECTION I OF THIS ORDINANCE; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE. <br /> <br />Whereas, a Public Hearing on the question of establishing a future land use designation of the <br />property hereinafter described has been duly held in the City of Casselberry, Florida and at such hearing, <br />interested parties and citizens for and/or against the proposed establishment of the future land use <br />designation were heard; <br /> <br />Whereas, the Casselberry Planning and Zoning Commission/Land Planning Agency has held a <br />public hearing with due public notice to consider the comprehensive plan amendment; <br /> <br />Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has <br />held a public hearing to consider the comprehensive plan amendment and has determined that the Future <br />Land Use designation of said property shall be established as MDR (Medium Density Residential) as that <br />designation is defined in Future Land Use Element Policy FLU A (2), as amended and supplemented, of <br />Comprehensive Plan of the City of Casselberry, Florida, and <br /> <br />Whereas, such amendments are permitted subject to the provisions of Chapter 163, F.S. and Rule <br />9]-11, FAG <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and <br />supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, <br />regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same <br />is hereby amended by this amendment LPA 00-M-07 to: Amend the Official Future Land Use Map to <br />include property as Medium Density Residential as requested by the owner of said land as described: <br />LEG LOT 2 (LESS RD) BLK G LAKE KATHRYN PARK PB 8 PG 7 <br /> <br />LEG LOT 3 (LESS RD) BLK G LAKE KATHRYN PARK PB 8 PG 7 <br /> <br />SECTION II. Codification. It is the intention of the City Commission of the City of Casselberry, <br />Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part <br />of the Comprehensive Plan 1990-2010 of the City of Casselberry, Florida; that the Sections of this <br />Ordinance may be renumbered or re-lettered to accomplish such intention; that the word, "Ordinance," <br />may be changed to "Section," "Article," or other appropriate word. <br /> <br />SECTION III. Conflicts. All Ordinances or parts of Ordinances in conflict with any of the <br />provisions of this Ordinance are hereby repealed. <br /> <br />00-997; Page 1 <br />
