ORDINANCE # 00-997 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION OF MDR (MEDIUM DENSITY RESIDENTIAL) FOR TIIAT PARCEL DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. Whereas, a Public Hearing on the question of establishing a future land use designation of the property hereinafter described has been duly held in the City of Casselberry, Florida and at such hearing, interested parties and citizens for and/or against the proposed establishment of the future land use designation were heard; Whereas, the Casselberry Planning and Zoning Commission/Land Planning Agency has held a public hearing with due public notice to consider the comprehensive plan amendment; Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held a public hearing to consider the comprehensive plan amendment and has determined that the Future Land Use designation of said property shall be established as MDR (Medium Density Residential) as that designation is defined in Future Land Use Element Policy FLU A (2), as amended and supplemented, of Comprehensive Plan of the City of Casselberry, Florida, and Whereas, such amendments are permitted subject to the provisions of Chapter 163, F.S. and Rule 9]-11, FAG NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same is hereby amended by this amendment LPA 00-M-07 to: Amend the Official Future Land Use Map to include property as Medium Density Residential as requested by the owner of said land as described: LEG LOT 2 (LESS RD) BLK G LAKE KATHRYN PARK PB 8 PG 7 LEG LOT 3 (LESS RD) BLK G LAKE KATHRYN PARK PB 8 PG 7 SECTION II. Codification. It is the intention of the City Commission of the City of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Comprehensive Plan 1990-2010 of the City of Casselberry, Florida; that the Sections of this Ordinance may be renumbered or re-lettered to accomplish such intention; that the word, "Ordinance," may be changed to "Section," "Article," or other appropriate word. SECTION III. Conflicts. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. 00-997; Page 1
