<br />ORDINANCE # 00-983 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY <br />OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL <br />FUTIJRE LAND USE MAP ESTABLISHING THE FUTIJRE LAND USE DESIGNATION <br />OF MDR (MEDIUM DENSITY RESIDENTIAL) FOR THAT PARCEL DESCRIBED IN <br />SECTION I OF THIS ORDINANCE; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE. <br /> <br />Whereas, a Public Hearing on the question of establishing a future land use designation of the <br />property hereinafter described has been duly held in the City of Casselberty, Florida and at such hearing, <br />interested parties and citizens for and/or against the proposed establishment of the future land use <br />designation were heard; <br /> <br />Whereas, the Casselbeny Planning and Zoning Commission/Land Planning Agency has held a <br />public hearing with due public notice to consider the comprehensive plan amendment; <br /> <br />Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has <br />held a public hearing to consider the comprehensive plan amendment and has determined that the Future <br />Land Use designation of said propeny shall be established as MDR (M:edium Density Residentia~ as that <br />designation is defined in Future Land Use Element Policy FLU A (7), as amended and supplemented, of <br />Comprehensive Plan of the City of Casselbeny, Florida, and <br /> <br />Whereas, such amendments are permitted subject to the provisions of Chapter 163, F.S. and Rule <br />9]-11, FA.C. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66-29 of the City of Casselbeny Code, as amended and <br />supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselbeny, Florida, <br />regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same <br />is hereby amended by this amendment LPA 00-M-02 to: Amend the Official Future Land Use Map to <br />include property as Medium Density Residential as requested by the owner of said land as described: <br /> <br />LEG WLY 200 IT OF ELY 250 IT OF SLY 400 IT (LESS RD ON S) & WLY 50 IT OF ELY 300 IT OF <br />NLY 200 IT OF SLY 400 IT OF BLK C & W 1/2 OF N 100 IT OF VACD ST ON E BLK C LAKE <br />KA1HRYNPARKPB 8 PG 7 <br /> <br />And on Exhibit 1. <br /> <br />SECTION II. Codification. It is the intention of the City Commission of the City of Casselberry, <br />Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part <br />of the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this Ordinance may be <br />renumbered or re-Iettered to accomplish such intention; that the word, "0 rdinance" may be changed to <br />"Section," "Anicle," or other appropriate word. <br /> <br />00-983: Page I <br />
