ORDINANCE # 99-973 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN ARTICLE IV, SECTION 2-4.3, UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; ESTABLISHING THE ZONING CLASSIFICATION OF CG (COMMERCIAL GENERAL) FOR THAT PARCEL DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. Whereas, a Public Hearing on the question of establishing zoning classification of the property hereinafter described has been duly held in the City of Casselberry. Florida and at such hearing, interested parties and citizens for and/or against the proposed establishment of zoning classification were heard; and Whereas, the property hereinafter described is designated as C (Commercial) on the Casselberry Comprehensive Plan Future Land Use Map; and Whereas, the CG (Commercial General) zoning classification is consistent with the C (Commercial) Future Land Use Map designation; and Whereas, after said Public Hearing, the City Commission ofthe City of Casselberry, Florida, has determined that the zoning classification of said property shall be established as CG (Commercial General) as that classification is defined in Articles IV and V of Chapter II, as amended and supplemented, of the Unified Land Development Regulations, Code of Ordinances of the City of Casselberry, Florida, and NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That the Official Zoning Map established in Article IV Section 2-4.3 of the Unified Land Development Regulations of the Code of Ordinances of the City of Casselberry, Florida, as amended and supplemented, for those parcels ofland located on the eastside of S.R. 436 at Fern Park Blvd., more specifically described as follows: Sec 17, Twn 21S, Rng 30E, Beg NEe of SW 'A of SE lA, Run W 540.31 ft. S 47 DEG 12 min 42 sec E 25.94 ft S 42 DEG 47 min 18 sec W 250 ft S 47 DEG 12 MIN42 Sec E 203.38 ft N 42 deg 47 min 18 sec E 250 ft S 47 deg 12 min 42 sec E 522.76 ft N 508.87 ft to Beg. LESS the easterly 100 ft. and is hereby amended and given the zoning district classification as follows: CG (Commercial General) as that classification is defined in Articles IV and V of Chapter II, as amended and supplemented, of the Unified Land Development Regulations, Code of Ordinances of the City of Casselberry, Florida. SECTION II. Conflicts. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION IV. Effective Date. This Ordinance shall become effective ten (10) days after its passage and adoption. ~ FIRST READING this 0~ day of .
