RESOLUTION 07-1767 A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, MAKING FINDINGS; DESIGNATING PARCEL 04-21-30-511-0AOO-0080 AS A BROWNFIELD AREA WITHIN THE CITY OF CASSELBERRY FOR THE PURPOSE OF ENVIRONMENTAL REHABILITATION AND ECONOMIC DEVELOPMENT, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the State of Florida has provided in Sections 376.77 - 376.85, Florida Statutes for the designation by resolution, at the request of the property owner, of one or more parcels as a "Brownfield Area", and for the corresponding provision of enviromnental remediation and economic development; and WHEREAS, Saticoy Investments Company, LLC ("Saticoy") has requested designation as a Brownfield Area the parcel (04-21-30-511-0AOO-0080) depicted in Exhibit A, attached hereto and incorporated herein by reference; and WHEREAS, the City Commission of the City of Casselberry has reviewed the requirements for Brownfield Area designation, as specified in Florida Statutes Section 376.80(2)(b), and has determined that the proposed area qualifies for designation as a Brownfield Area because the following requirements of Florida Statutes Section 376.80(2)(b) have been met: I. Saticoy has received consent from the property owners, which are within the Brownfield Area, to remediate those properties, and has agreed to rehabilitate and redevelop the Brownfield Area depicted in Exhibit A. 2. The rehabilitation and redevelopment of the proposed Brownfield Area will result in economic production in the area and the creation of at least 5 new permanent jobs at the Brownfield Area, which are full-time equivalent positions not associated with implementation of the rehabilitation agreement, or with the demolition or construction associated with the redevelopment agreement. 3. The redevelopment of the proposed Brownfield Area is consistent with the City of Casselberry's Comprehensive Plan and is a perrnittable use under the City's land development regulations. 4. Proper notice of the proposed rehabilitation of the Brownfield Area has been provided to neighbors and nearby residents and published in the newspaper, and Saticoy has provided those receiving notice the opportunity to provide comments and suggestions about rehabilitation. 5. Saticoy has provided reasonable assurance that it has sufficient financial resources to implement and complete the rehabilitation agreement and the redevelopment plan; and WHEREAS, the City Commission of the City of Casselberry wishes to notify the Florida Department of Enviromnental Protection of its decision to designate a Brownfield Area for rehabilitation for purposes of Florida Statutes Sections 376.77-376.85; and
