<br />RESOLUTION 07-1767 <br /> <br />A RESOLUTION OF THE CITY OF CASSELBERRY, <br />FLORIDA, MAKING FINDINGS; DESIGNATING PARCEL <br />04-21-30-511-0AOO-0080 AS A BROWNFIELD AREA <br />WITHIN THE CITY OF CASSELBERRY FOR THE <br />PURPOSE OF ENVIRONMENTAL REHABILITATION <br />AND ECONOMIC DEVELOPMENT, AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the State of Florida has provided in Sections 376.77 - 376.85, Florida Statutes for <br />the designation by resolution, at the request of the property owner, of one or more parcels as a <br />"Brownfield Area", and for the corresponding provision of enviromnental remediation and economic <br />development; and <br /> <br />WHEREAS, Saticoy Investments Company, LLC ("Saticoy") has requested designation as a <br />Brownfield Area the parcel (04-21-30-511-0AOO-0080) depicted in Exhibit A, attached hereto and <br />incorporated herein by reference; and <br /> <br />WHEREAS, the City Commission of the City of Casselberry has reviewed the requirements for <br />Brownfield Area designation, as specified in Florida Statutes Section 376.80(2)(b), and has determined <br />that the proposed area qualifies for designation as a Brownfield Area because the following requirements <br />of Florida Statutes Section 376.80(2)(b) have been met: <br /> <br />I. Saticoy has received consent from the property owners, which are within the Brownfield <br />Area, to remediate those properties, and has agreed to rehabilitate and redevelop the <br />Brownfield Area depicted in Exhibit A. <br /> <br />2. The rehabilitation and redevelopment of the proposed Brownfield Area will result in <br />economic production in the area and the creation of at least 5 new permanent jobs at the <br />Brownfield Area, which are full-time equivalent positions not associated with <br />implementation of the rehabilitation agreement, or with the demolition or construction <br />associated with the redevelopment agreement. <br /> <br />3. The redevelopment of the proposed Brownfield Area is consistent with the City of <br />Casselberry's Comprehensive Plan and is a perrnittable use under the City's land <br />development regulations. <br /> <br />4. Proper notice of the proposed rehabilitation of the Brownfield Area has been provided to <br />neighbors and nearby residents and published in the newspaper, and Saticoy has provided <br />those receiving notice the opportunity to provide comments and suggestions about <br />rehabilitation. <br /> <br />5. Saticoy has provided reasonable assurance that it has sufficient financial resources to <br />implement and complete the rehabilitation agreement and the redevelopment plan; and <br /> <br />WHEREAS, the City Commission of the City of Casselberry wishes to notify the Florida <br />Department of Enviromnental Protection of its decision to designate a Brownfield Area for rehabilitation <br />for purposes of Florida Statutes Sections 376.77-376.85; and <br />
