Staff Report: Mr. Eugene Miller, Interim City Manager, stated Resolution 07-1758 provides for approval of a petition to vacate and abandon a portion 0 fa utility easement. This particular site is a redevelopment of several parcels located on the west side of U.S. Highway 17-92 between Plumosa Avenue and Concord Drive. Due to the age of the prior development, there are several easements that are no longer applicable to the redevelopment of the site. Letters of no objection have been received from Embarq, Bright House Networks, Progress Energy, and TECO Peoples Gas. Public Works has no utilities in this easement and has no objections. Budget Impact: There is no cost associated with this request. Recommendation: The Interim City Manager and the Public Works Director recommended approval of Resolution 07-1758 as presented. MOTION: Commissioner Solomon moved to approve Resolution 07-1758, as presented. Motion was seconded by Vice Mayor Doerner. Motion carried unanimously by voice vote. H. RESOLUTION 07-1759 - SECOND RENEWAL OF FLORIDA DEPARTMENT OF TRANSPORTATION HIGHWAY MAINTENANCE MEMORANDUM OF AGREEMENT FOR RIGHT-OF-W A YMAINTENANCE ONU.S. HIGHWAY 17- 92 AND STATE ROAD 436 The City Clerk read Resolution 07-1759 by title as follows: "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, TO ENTER INTO THE SECOND RENEW AL OF THE IDGHW A YMAlNTENANCEMEMORANDUM OF AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." Staff Report: Mr. Eugene Miller, Interim City Manager, stated Resolution 07-1759 provides for the second renewal ofthe Memorandum of Agreement between the City and the Florida Department of Transportation (FDOT) for compensation to the City for the maintenance ofthe rights-of-way along U.S. Highway 17-92 and State Road 436 including landscape maintenance, street sweeping, sidewalk repair and other minor roadway repair as warranted. For the past nine years, the City has maintained part of the State Highway System under a Memorandum of Agreement with FDOT. The second renewal will commence on May I, 2007 and will end on April 30, 2008. Compensation totals $62,221 per year.
