This particular site is a redevelopment <br />of several parcels located on the west side of U.S. Highway 17-92 between Plumosa Avenue and Concord <br />Drive. Due to the age of the prior development, there are several easements that are no longer applicable to <br />the redevelopment of the site. Letters of no objection have been received from Embarq, Bright House <br />Networks, Progress Energy, and TECO Peoples Gas. Public Works has no utilities in this easement and has <br />no objections. <br /> <br />Budget Impact: There is no cost associated with this request. <br /> <br />Recommendation: The Interim City Manager and the Public Works Director recommended approval of <br />Resolution 07-1758 as presented. <br /> <br />MOTION: <br /> <br />Commissioner Solomon moved to approve Resolution <br />07-1758, as presented. Motion was seconded by Vice <br />Mayor Doerner. Motion carried unanimously by voice <br />vote. <br /> <br />H. RESOLUTION 07-1759 - SECOND RENEWAL OF FLORIDA DEPARTMENT <br />OF TRANSPORTATION HIGHWAY MAINTENANCE MEMORANDUM OF <br />AGREEMENT FOR RIGHT-OF-W A YMAINTENANCE ONU.S. HIGHWAY 17- <br />92 AND STATE ROAD 436 <br /> <br />The City Clerk read Resolution 07-1759 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, TO ENTER INTO <br />THE SECOND RENEW AL OF THE IDGHW A YMAlNTENANCEMEMORANDUM OF <br />AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Staff Report: Mr. Eugene Miller, Interim City Manager, stated Resolution 07-1759 provides for the second <br />renewal ofthe Memorandum of Agreement between the City and the Florida Department of Transportation <br />(FDOT) for compensation to the City for the maintenance ofthe rights-of-way along U.S. Highway 17-92 <br />and State Road 436 including landscape maintenance, street sweeping, sidewalk repair and other minor <br />roadway repair as warranted. For the past nine years, the City has maintained part of the State Highway <br />System under a Memorandum of Agreement with FDOT. The second renewal will commence on May I, <br />2007 and will end on April 30, 2008. Compensation totals $62,221 per year. <br />
