RESOLUTION 07 -1757 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING CLOSING, VACATING AND ABANDONING EASEMENT RESERVED IN NON- EXCLUSIVE SANITARY SEWER EASEMENT, OF THE PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA (ALSO KNOWN AS HOWELL BRANCH CORNERS DEVELOPMENT); PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, a petition was filed with the City Commission of the City of Casselberry, Florida, to close, vacate and abandon easement as recorded in Official Record Book 1360, Pages 1277-1279 of the Public Records of Seminole County, Florida, as described in Exhibit "A". WHEREAS, all affected utilities have reviewed the petition; and WHEREAS, the City Commission finds that the closing, vacating and abandonment of a portion of said easement will not present a detriment to either the City of Casselberry, Florida, or the public. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: Section I. The City Commission of the City of Casselberry hereby approves the closing, vacating and abandonment of an easement described on Exhibit "A" in the City of Casselberry as of this date. The City Commission of the City of Casselberry, Florida, renounces any rights in and to the afore-described utility easement, attached as "Exhibit A", and authorizes the Mayor to sign the resolution. Section II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. Section III. Severabilitv. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
