RESOLUTION 07-1752 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF A CONTRACT BETWEEN APEC, INC., AND THE CITY OF CASSELBERRY FOR THE CONSTRUCTION OF THE TRIPLET LAKE DRIVE AND US IDGHWAY 17-92 INTERSECTION IMPROVEMENTS PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry has identified the need to re-align and improve the intersection of Triplet Lake Drive and US Highway 17-92 including infrastructure improvements on Triplet Lake Drive, from Quail Pond Circle through Target to Melody Lane; and WHEREAS, the City of Casselberry advertised for bids, on November 29, 2006, for the Triplet Lake Drive and US Highway 17-92 Intersection Improvements Project; and WHEREAS, on January 16, 2007, the City received four (4) sealed bids; and WHEREAS, the City staff has reviewed the bid proposal from APEC, Inc., and found it to be responsive, responsible, and adequate to meet the project requirements of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the contract with APEC, Inc., (attached as "Exhibit A"), and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION m. Severabilitv. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
