<br />(g) Keep Owner informed. <br />4. Broker Cooperation: Agcnt is authorized to employ outside brokcrs to sell this Properly <br />and, if an outside broker or brokers procure a sale, Owner will compensate the outside broker or brokers as <br />provided hcrein. <br />5. Advertising: Agent is authorized to ad\'el1ise the Properly for sale at such time and by use <br />of media as it deems neCeSS31)' and appropriate. Agent is authoriz.ed to make news releases 10 the press as <br />part of Agent's marketing of the Property. <br />6. Exclusiveness of Agreement: During the term of this Agreement, Owner ''''ill not authorize <br />any other person, linn or corporation other than Agent to have or maintain any "For Sale" sign on or about <br />the Property, and Owner will keep Agent informed concerning inquiries by any person, firm or corporation. <br />7. Compensation: <br />- - -'... ---W'--AgentTompensation:- . ----.-- .-- <br />(I) Agent is entitled to a commission if Owner sells all or part of the Property <br />during the telln of this Agreement. Ajoint venture and a tax. free exchange will each be considered a sale of <br />the Property. A taking by condemnation proceeding or sale in lieu of condemnation proceedings will not be <br />considered a sale of the Property. <br />(2) Agent is entitled to a commission if Owner enters into a contract to sell all <br />or pali of the Property within six (6) months after the termination of this Agreement with any prospect with <br />whom negotiations are pending at the time of termination of this Agreement and thereafter sells the Propcrty <br />in accordance with that contract. Agent will forward a list of prospects to Owner within thirty (30) days after <br />the termination date. <br /> <br />(b) Rate of Compensation: <br />(I) Except as provided 111 paragraph 7(b )(2), Owner shall pay Agent a <br />commission equal to four percent (4%) of the gross sales price paid for each and every portion of the <br />Property sold during the period of this Agreement. <br />(2) For each sale procured by Agent with the assistance of another licensed real <br />estate broker. Owner shall pay a commission equal to six percent (6%) of the gross sales price, to bc <br />appol1ioned no less than three percent (3%) to Agent and no more than three percent (3%) to other broker, <br />unless all parties in such a transaction agree otherwise in \vriting. <br />(c) Payment: Commissions are payable at the closing of the transaction for which the <br />commissions are earned. <br /> <br />(d) Entire Compensation: No fees, commission or compensation shall be paid for <br /> <br /> <br />services provided by Agent except as expressly set forth in this Agreement or as otherwise agreed III a <br /> <br /> <br />writing document executed by Agent and Owner. <br /> <br />tV <br />
