<br />RESOLUTION 07-1747 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF THE INTERLOCAL AGREEMENT BETWEEN SEMINOLE COUNTY AND <br />THE INCORPORATED CITIES WITHIN SEMINOLE COUNTY FOR TOTAL MAXIMUM <br />DAILY LOAD (TMDL) ACTIVITIES; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br /> <br />WHEREAS, the State's TMDL program requirement will be reflected in the National Pollutant <br />Discharge Elimination System (NPDES) permit beginning in 2007; and <br /> <br />WHEREAS, meeting the requirements of the State TMDL program will require local governmental <br />agencies to cooperate on TMDL-related studies and projects; and <br /> <br />WHEREAS, such intergovemmental cooperation will result in more efficient, cost-effective TMDL <br />compliance for each governmental agency, and less duplication of efforts overall; and <br /> <br />WHEREAS, City staff has reviewed the Interlocal Agreement with Seminole County and incorporated <br />cities within Seminole County for Total Maximum Daily Load (TMDL) Activities and find it to be favorable to the <br />City. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Interlocal Agreement <br />with Seminole County and incorporated cities within Seminole County for Total Maximum Daily Load (TMDL) <br />Activities (attached as "Exhibit A"), and authorizes the Mayor to execute said document on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of <br />this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves to be invalid, <br />unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other <br />Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
