First Reading of Ordinance 06-1208 - Commercial Solid Waste Disposal Glitch Ordinance <br /> <br />The City Clerk read Ordinance 06- I 208 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA AMENDING <br />ORDINANCE 06-1190; SPECIFICALLY AMENDING ARTICLE III, SEe. 70-56(B), <br />SERVICE DURING DISASTER; SEe. 70-57(B), COLLECTION SCHEDULES; SEe. <br />70-59, LITTER; SEC. 70-62(D) AND (K); DELETING SUBSECTIONS (H) AND (I) <br />OF SEe. 70-62, FRANCHISEE'S EQUIPMENT; AMENDING SEe. 70-66, <br />CHARGES AND RATES; SEe. 70-69(A), COMPENSATION AND PAYMENT; SEe. <br />70-77, PERFORMANCE BOND; SEe. 70-78, LIABILITY; SEe. 70-83, DIRECTOR <br />TO BE ARBITRATOR; SEC. 70-85(B), BOOKS, RECORDS, AND AUDIT; TO <br />CORRECT GLITCHES AND MAKE MISCELLANEOUS ADJUSTMENTS; <br />PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS, AND AN <br />EFFECTIVE DATE." <br /> <br />Staff Presentation: Ordinance 06-1208 amends Ordinance 06-1 190, City Code Chapter 70, Solid Waste, <br />to correct certain glitches and implement other changes deemed necessary. These changes resulted after <br />several solid waste franchisees provided comments and identified items that required further clarification, <br />and/or revisions to the commercial solid waste operation. Specifically, these items include the following: <br /> <br />. <br /> <br />Requiring service to its customers in anticipation of a major storm or disaster, <br /> <br />. <br /> <br />Requiring notification to the City of customers that routinely leave materials around the <br />container, rather than inside the container, <br /> <br />. <br /> <br />Addressing markings on dumpsters reflecting "on-call" pick-up in addition to the scheduled <br />pick-up, <br /> <br />. <br /> <br />Removing annual inspection of the franchisee's trucks and equipment to be conducted by <br />the City of Casselberry, <br /> <br />. <br /> <br />Rotating collection services to be provided free of charge to the City among all Franchisees, <br /> <br />. <br /> <br />Moditying the performance bond requirements to better correlate to the smaller and <br />competitive solid waste collection business (i.e. compared to residential collection, in which <br />there is only one Franchisee), <br /> <br />. <br /> <br />Enhancing legal protection for the City, <br /> <br />. <br /> <br />Claritying arbitration to items not involving material default, and <br /> <br />. <br /> <br />Addressing typos within the Ordinance <br />
