<br />City Commission Meeting <br />October 9, 2006 <br />Page 3 <br /> <br />Staff Presentation: Ordinance 06-1198 amends the current future land use policy regarding the Industrial <br />Medium future land use designation, which was created to allow adult entertainment establishments/sexually <br />oriented businesses (AEE/SOB) to operate within the 1M designation. This is a large scale amendment to <br />the City's Comprehensive Plan and required review by the Department of Community Affairs. The <br />Department of Community Affairs provided a letter of compliance dated September 12, 2006. <br /> <br />Staff Recommendation: Recommend approval of Ordinance 06-1198 upon second reading and final public <br />hearing. <br /> <br />Audience Input: (A sign-up sheet was required for individuals wishing to comment on Ordinance 06-1198) <br /> <br />. John Casselberry, 700 S. Lost Lake Lane, Casselberry, Florida, spoke in opposition to Ordinance <br />06-1198. No one else came forward. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Susan Doerner to approve Ordinance 06-1198, <br />Comprehensive Plan Amendment (LPA 06-11), as presented on second <br />reading. Motion was seconded by Commissioner Linda Hart and carried on <br />a 5 - 0 vote. <br /> <br />B. Public Hearing and Second Reading of Ordinance 06-1206 - Amendment to the City Code, Part II, <br />Chapter 26 - Businesses, Article II, Occupational License Tax - Change in Terminology <br /> <br />The City Clerk read Ordinance 06-1206 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />THE CASSELBERRY CODE OF ORDINANCES, PART II, CHAPTER 26, <br />"BUSINESSES", ARTICLE II, "OCCUPATIONAL LICENSE TAX", DELETING <br />THE TERM "OCCUPATIONAL LICENSE TAX" AND REPLACING WITH THE <br />TERM "LOCAL BUSINESS TAX", DELETING THE TERM "OCCUPATIONAL <br />LICENSE" AND REPLACING WITH THE TERM" LOCAL BUSINESS TAX <br />RECEIPT" OR "RECEIPT"; REPEALING SECTION 26-29, "OCCUPATIONAL <br />LICENSE REVIEW BOARD"; PROVIDING CONSISTENT TERMINOLOGY <br />THROUGHOUT THE CHAPTER; PROVIDING MINOR FORMATTING EDITS; <br />PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND AN <br />EFFECTIVE DATE." <br /> <br />Lel!al Advertisement: Advertised in the Orlando Sentinel on Wednesday, September 13,2006. <br /> <br />Staff Presentation: Ordinance 06-1206 changes the term "Occupational Licensing" to "Local Business Tax" <br />pursuant to Florida Legislative Amendment2006-152. This ordinance is in conjunction with Resolution 06- <br />1715, which amended the Interlocal Agreement with Seminole County regarding the collection of <br />Occupational License Taxes. The City Commission approved Ordinance 06-1206 unanimously on first <br />reading at their meeting of September 25, 2006. Commission also approved Resolution 06-1715 at the <br />September 25, 2006 Meeting. <br />
