<br />RESOLUTION 06-1707 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, ADOPTING THE <br />TENTATIVE OPERATING MILLAGE RATE OF 5.00 MILLS FOR THE CITY OF <br />CASSELBERRY FOR THE FISCAL YEAR COMMENCING ON OCTOBER I, 2006 AND <br />ENDING ON SEPTEMBER 30, 2007; ANNOUNCING THE PERCENTAGE BY WHICH THE <br />TENTATIVE OPERATING MILLAGE RATE EXCEEDS THE ROLLED-BACK RATE; <br />PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE." <br /> <br />WHEREAS, the City Commission of the City of Casselberry must provide public notice of, and hold a public <br />hearing on the tentative millage rate pursuant to Florida Statute 200.065, Subparagraph (c); and <br /> <br />WHEREAS, the public notice for the public hearing for the tentative millage rate was provided to all taxpayers <br />of the City of Casselberry by the Seminole County Property Appraiser in the "TRIM" notice which was mailed out in <br />August 2006; and <br /> <br />WHEREAS, the City Commission of the City of Casselberry desires to adopt the tentative operating millage <br />rate and publicly announce their percentage change by which the tentative proposed operating millage rate exceeds the <br />rolled-back rate; and <br /> <br />WHEREAS, the City Commission of the City of Casselberry deems that this Resolution is in the best interest <br />of the public health, safety, and welfare of the citizens of Casselberry. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. Tentative Milla!!e Rate. The City Commission adopts its tentative operating millage rate of <br />5.00 mills for the fiscal year commencing October 1,2006 and ending September 30, 2007. <br /> <br />SECTION II. Rolled-Back Rate. The tentative operating millage rate of5.00 mills is a 24.05 percent increase <br />from the computed rolled-back rate of 4.037 mills as certified by the Seminole County Property Appraiser. <br /> <br />SECTION III. Public Notice. Within fifteen (15) days of the date of this Resolution, the City Clerk shall <br />advertise in a newspaper of general circulation the City's intent to finally adopt the millage rate and budget and shall <br />hold a public hearing to finalize the budget and adopt the millage rate not less than two (2) days or more than (5) days <br />after the date the advertisement is first published. <br /> <br />SECTION IV. Severabilitv. If any section, subsection, sentence, clause, phrase, word, or portion of this <br />Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall <br />be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining <br />portion hereto. <br /> <br />SECTION V.
