<br />the Franchisee. The Director of Public Works shall make such explanation as <br /> <br />may be necessary to complete, explain or make definite the provisions of the <br /> <br />Franchise, and his findings and conclusions shall be final and binding upon both <br /> <br />parties. <br />SECTION 12. Section 70-85(b), Books, Records, and Audit, of Article III, shall be <br /> <br />amended as follows: <br /> <br />70-85. BOOKS. RECORDS. AND AUDIT. <br /> <br />* * * <br /> <br />b. Franchisee shall furnish the City with an annual audit, due <br /> <br />November 15 of each calendar year, for the service year or portion thereof ending <br /> <br /> <br />the previous September 30th. Said audit shall be prepared by an independent <br /> <br /> <br />certified public accountant comp!ete with the creaiter's auditor's opinion which <br /> <br /> <br />opinion shall be acceptable to the City. The audit shall reflect the accuracy and <br /> <br />completeness of the information provided the City by the Franchisee with special <br /> <br />attention to the franchise fee. The City reserves the right to perform its own <br /> <br />independent audit of Franchisee's books and records at all times upon reasonable <br /> <br />notice. <br /> <br />* * * <br /> <br />SECTION 13. SEVERABILITY. If any Section or portion of a Section of this <br /> <br />Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or <br /> <br />impair the validity, force, or effect of any other Section or part of this Ordinance. <br /> <br /> <br />SECTION 14. CODIFICATION. It is the intention of the City Commission of the <br /> <br /> <br />City of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall <br /> <br />9 <br />
