<br />provide the City of Casselberry with a more appropriate set of controls regulating the <br /> <br />permitted location of adult entertainment establishments and sexually oriented businesses; <br /> <br />WHEREAS, the City of Casselberry has examined reports and studies recognizing <br /> <br />the adverse secondary effect of adult entertainment and sexually oriented businesses, <br /> <br />which studies are on file at Casselberry City Hall, as set forth in Ordinance 99-934 and <br /> <br />additional studies recently placed on file at City Hall, which are incorporated herein; <br /> <br />WHEREAS, the City of Casselberry finds that eliminating adult entertainment <br /> <br />establishments and sexually oriented businesses as a permissible use in the Commercial <br /> <br />General ("CG") district is a legitimate governmental interest due to concerns about adverse <br /> <br />secondary effects and the City's desire to improve the quality and character of the City's <br /> <br />commercial areas; <br /> <br />WHEREAS, Ordinance No. 06-1200 created a new Industrial Medium ("1M") zoning <br /> <br />district which allows adult entertainment and sexually oriented businesses as a permitted <br /> <br />use and provides alternative sites for the location of adult entertainment and sexually <br /> <br />oriented businesses; <br /> <br />WHEREAS, the City Commission of the City of Casselberry desires to retain, with <br /> <br />amendments, Section 14-76 of the Code, entitled "Nonconforming Uses" to allow the <br /> <br />existing adult entertainment and sexually oriented businesses in the CG district to maintain <br /> <br />their nonconforming use status; <br /> <br />WHEREAS, the 1M zoning district is more suited for adult entertainment and <br /> <br />sexually oriented businesses due to locational criteria, setback requirements and other <br /> <br />design standards which protect residential and commercial areas; <br /> <br />WHEREAS, the provisions of this Ordinance are necessary to protect and preserve <br />Ordinance No. 06-1201 <br />Page 2 of 8 <br />
