<br />ORDINANCE NO. 06-1193 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />REPEALING SECTION 1-4.3(D)(5) OF THE CITY'S UNIFIED LAND <br />DEVELOPMENT REGULATIONS, FIRE RELATED FEES; AMENDING <br />CHAPTER 42, ARTICLE VI, TO ADD A NEW SECTION 42-177 OF THE <br />CITY CODE OF ORDINANCES, BASED ON SECTION 1-4.3(D)(5) OF <br />THE UNIFIED LAND DEVELOPMENT REGULATIONS, ENTITLED <br />"FIRE PREVENTION RELATED FEES," TO IMPOSE EXISTING FEES <br />AND ADD FEES FOR FIRE INSPECTIONS, PERMITS AND REVIEWS; <br />TO PROVIDE THAT THE FEES WILL BE SET BY RESOLUTION; <br />PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS, AND <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission finds that it would be more logical to have fire <br /> <br />prevention related fees under the Code of Ordinances rather than the Unified Land <br /> <br />Development Regulations; and <br /> <br />WHEREAS, the City Commission finds that based on the increased costs of <br /> <br />administering inspections and review services, an increase in the fire related fees <br /> <br />previously set forth in Section 1-4.3(0)(5) of the City's Unified Land Development <br /> <br />Regulations, is necessary; and <br /> <br />WHEREAS, the City Commission finds that additional fire inspections and review <br /> <br />fees, appeal fees, research and other administrative fees should be added to Chapter <br /> <br />42, Fire Protection and Prevention, Article VI; and <br /> <br />WHEREAS, Fla. Stat. 9633.081(1) authorizes such fees; and <br /> <br />WHEREAS, the City Commission would like to have the ability to set the fees by <br /> <br />resolution so that fees may be changed in the future by resolution instead of ordinance. <br /> <br />NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br /> <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION 1.
