Florida 32707 <br /> <br />ORDINANCE No. 06.1185 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND <br />USE MAP, ESTABLISHING THE COMMERCIAL FUTURE LAND USE MAP DESIGNATION <br />OF C (Commercial) FOR THE PARCEL AS DESCRIBED IN SECTION I OF THIS <br />ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br /> <br />WHEREAS, the property described in Section I was annexed into the corporate boundary of the City of <br />Casselbeny, effective November 3,2004; and <br /> <br />WHEREAS, the Casselbeny Planning and Zoning Commission/Local Planning Agency has held a public <br />hearing with due pUblic notice to consider this Comprehensive Plan Amendment; and <br /> <br />WHEREAS, a Public Hearing on the question of amending the City of Casselbeny Future Land Use Map <br />designations of the properties hereinafter described. has been duly held by the City Commission of the City of <br />Casselbeny, Florida, and at such hearing, interested parties and citizens for and/or against the proposed <br />establishment of the City of Casselbeny Future Land Use Map designations were heard; and <br /> <br />WHEREAS, after said Public Hearing, the City Commission of the City of Casselbeny, Florida, has held a <br />public hearing to consider the Comprehensive Plan Amendment and has determined that the Future Land Use Map <br />designations of said properties provided in Section I, herein, shall be established as specified as those designations <br />are defined in Future Land Use Element Objective FLU 1, as amended and supplemented, of the Comprehensive Plan <br />of the City of Casselbeny, Florida; and <br /> <br />WHEREAS, such amendments are permitted, subject to the provisions of Chapter 163 of the Florida Statutes <br />and Rule 9J-ll of the Florida Administrative Code. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66-29 of the City of Casselbeny's Code of Ordinances, as amended <br />and supplemented, said Chapter adopting the City of Casselbeny's Comprehensive Plan, regulating and restricting <br />the use of lands within the City of Casselbeny, Florida, be, and the same is hereby amended to include property as <br />Commercial, for those parcels of land located on the northem side of Howell Branch Road, west of the intersection of <br />SR 436 as shown on "ExhiM A" totaling 0.466 (+/-) acres in size and described as follows: <br /> <br />Parcel 10 Number: 28-21-30-300-056N-0000 <br />SEC 28 TWP 21S RGE 30E BEG 651.44 FT E & 96.31 FT N OF S 1/4 COR RUN N 111.69 FT E 180 FT S <br /> <br />City of Casselberry, Florida <br />Ordinance No. 06-1185 <br />Page 1012 <br />
