Wells, AICP <br />Community Development Di_r <br />City of Cesselbeny <br />95 TripIelLakeDrive <br />Casseibeny, Florida 32707 <br /> <br />ORDINANCE No. 06-1181 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND <br />USE MAP, ESTABLISHING THE COMMERCIAL FUTURE LAND USE MAP DESIGNATION <br />OF C (Commercial) FOR THE PARCELS AS DESCRIBED IN SECTION I OF THIS <br />ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br /> <br />WHEREAS, the properties described in Section I are located within the corporate boundary of the City of <br />Casselberry; and <br /> <br />WHEREAS, the Casselberry Planning and Zoning Commission/Local Planning Agency has held a public <br />hearing with due public notice to consider this Comprehensive Plan Amendment; and <br /> <br />WHEREAS, a Public Hearing on the question of amending the City of Casselberry Future Land Use Map <br />designations of the properties hereinafter described, has been duly held by the City Commission of the City of <br />Casselberry, Florida, and at such hearing, interested parties and citizens for and/or against the proposed <br />establishment of the City of Casselberry Future Land Use Map designations were heard; and <br /> <br />WHEREAS, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held a <br />public hearing to consider the Comprehensive Plan Amendment and has detennined that the Future Land Use Map <br />designations of said properties provided in Section I, herein, shall be established as specified as those designations <br />are defined in Future Land Use Element Objective FLU 1, as amended and supplemented, of the Comprehensive Plan <br />of the City of Casselberry, Florida; and <br /> <br />WHEREAS, such amendments are pennitted, subject to the provisions of Chapter 163 of the Florida Statutes <br />and Rule 9J-11 of the Florida Administrative Code. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry's Code of Ordinances, as amended <br />and supplemented, said Chapter adopting the City of Casselberry's Comprehensive Plan, regulating and restricting <br />the use of lands within the City of Casselberry, Florida, be, and the same is hereby amended to include property as <br />Commercial, for those parcels of land located on the westem side of State Road 436, south of the intersection of Red <br />Bug Lake Road as shown on 'Exhib~ A' totaling 2.89 (+/-) acres in size and described as follows: <br /> <br />ParcellD Number: 21-21-30-508-0000-0070 <br />LEG LOT 7 (LESS NL Y 125.35 FT) SCHATT DEVELOPMENT UNIT 2 PB 19 PG 58 <br /> <br />City of Casselberry, Florida <br />Ordinance No. 06-1181 <br />Page 1 of2 <br />
