<br />ORDINANCE 06-1177 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, <br />FLORIDA, AMENDING SECTION 36, PROCEDURE FOR <br />PLACING NAMES ON BALLOT; ALTERNATIVE METHOD <br />OF QUALIFYING OF ARTICLE VII, ELECTIONS, OF THE <br />CITY CHARTER; TO CHANGE THE DATE ON WHICH <br />PETITIONS ARE TO BE RECEIVED BY THE CITY; <br />AMENDING BY ORDINANCE, AS PROVIDED FOR IN <br />SECTION 100.3605, FLORIDA STATUTES; PROVIDING <br />FOR SEVERABILITY, CODIFICATION, CONFLICTS AND <br />EFFECTIVE DATE. <br /> <br />WHEREAS, Fla. Stat. ~99.095 was recently amended to provide that if the petition <br />process is used in lieu of a qualifying fee, the petitions shall be submitted to the Supervisor <br />of Elections office by noon on the 28th day preceding the first day of the qualifying period, <br />rather than the 21 5t day as was the case under the prior statute, necessitating a revision to <br />the City Charter; and <br /> <br />WHEREAS, pursuant to ~1 00.3605, Fla. Stat., a referendum is not required when <br />changing qualifying dates for members of the governing body; and <br /> <br />WHEREAS, words with double underlined type shall constitute additions to the <br />original text and E:trilm through shall constitute deletions to the original text. <br /> <br />NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA AS FOLLOWS: <br /> <br />SECTION ONE: Section 36, Procedure for placing names on ballot; alternative <br />method of qualifying, of Article VII, Elections, of the Charter of the City of Casselberry, <br />Florida, is hereby amended as follows: <br /> <br />Sec. 36. Procedure for placing names on ballot; alternative <br />method of qualifying. <br /> <br />Any elector may become a candidate for Mayor/Commissioner or <br />Commissioner by filing with the City Clerk an application to have <br />his/her name printed on the ballot as a candidate for a seat <br />specifically named from 8:00 a.m. to 5:00 p.m., Monday through <br />Friday, for the five-day period during the second full week in August. <br />Each person seeking election to the City Commission shall pay, at the <br />time of qualifying for office, a qualifying fee to the City Clerk. The <br />amount of the qualifying fee is one percent (1 %) of the annual salary <br />of the office.
