<br />ORDINANCE 06-1174 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING CHAPTER 62, PERSONNEL, ARTICLE XXI, <br />POLICE OFFICERS' AND FIREFIGHTERS' PENSION PLAN, BY <br />AMENDING SECTION 62-2002 ( c ) TO PROVIDE THE POLICE <br />CHIEF AND MANAGEMENT ADDITIONAL TIME TO CONSIDER <br />PARTICIPATION BY THE POLICE CHIEF IN THE POLICE <br />OFFICERS' AND FIREFIGHTERS' PENSION PLAN; <br />PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS <br />AND EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission approved an ordinance on June 27, <br />2005 changing various sections of the Police Officers' and Firefighters' Pension <br />Plan including a subsection 62-2002 ( c ) to allow the current Police Chief to opt <br />into the Pension Plan; and <br /> <br />WHEREAS, the City administration and the Police Chief require additional <br />time to review advantages and disadvantages of the Police Chief opting into the <br />plan; and <br /> <br />WHEREAS, the Police Officers' and Firefighters' Pension Board <br />recommended the adoption of this ordinance at its meeting of December 16, <br />2005. <br /> <br />NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COMMISSION <br />OF THE CITY OF CASSELBERRY, AS FOLLOWS: <br /> <br />SECTION 1. Section 62-2002 (c) is amended as follows: <br /> <br />Sec. 62-2002. (c) Opt in window. The current Police Chief, may, within <br />six A'lonths one year of the effective date of the ordinance adopting this <br />subsection, elect to reenter the System and receive Credited Service for all or a <br />part of his time of employment with the City, provided that the Police Chief <br />contributes to the Fund the sum that he would have contributed had he been a <br />Member of the System for the years or fractional parts of years for which he is <br />requesting credit, plus amounts actuarially determined such that the crediting of <br />service doe s not result in any cost to the Fund, plus payment for all professional <br />services rendered to the Board in connection with the purchase of years of <br />Credited Service. <br /> <br />SECTION 2 - SEVERABILITY. If any Section or portion of a Section of <br />this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be <br />
