MOTION: Moved by Commissioner Susan Doerner to approve Ordinance 06-1201, City Code Chapter 14 Amendments, as presented. Motion was seconded by Commissioner Colleen S. Hufford and carried on a 5 - 0 vote. E. First Reading of Ordinance 06-1202 Official Zoning Map Amendmentto Designate Properties as Industrial Medium (ZB 06-05) - Lots 3, 4, 5, 6 and 7 of the Northeast Industrial Park Replat The City Clerk read Ordinance 06-1202 by title as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN ARTICLE IV, SECTION 2-4.3, UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; ESTABLISHING THE ZONING CLASSIFICATION OF I-M, INDUSTRIAL-MEDIUM, FOR APPROXIMATELY FIVE (5) ACRES OF PROPERTY LYING BETWEEN BELLE AVENUE AND HELEN STREET, TO INCLUDE ADULT ENTERTAINMENT LAND USES; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE." Lel!al Advertisement: Advertised in the Orlando Sentinel on July 12, 2006. Staff Presentation: Ordinance 06-1202 amends the Official Zoning Map to designate properties, lots 3, 4, 5,6 and 7 of the Northeast Inustrial Park. These properties were annexed into the City on June 27, 2005 as part of the North Winter Park Drive realignment project. The properties are currently zoned Seminole County C3, (General Commercial and Wholesale). Staff is recommending the properties be zoned City of Casselberry 1M Zoning (Industrial-Medium). This designation allows adult entertainment establishments and sexually oriented businesses as a permitted use. The properties are located outside the required 2,500 foot distance separation between adult entertainment establishments and schools mandated by Florida Statutes. At their meeting of June 28, 2006, the Planning and Zoning Commission provided a favorable recommendation to the City Commission. The City Commission unanimously approved the ordinance on first reading on July 10, 2006. Staff Recommendation: Approval of Ordinance 06-1202. Audience Input: John Casselberry, 700 S. Lost Lake Lane, Casselberry, Florida spoke in opposition to the rezoning. The City should re-evaluate for retention ponds. MOTION: Moved by Commissioner Colleen S. Hufford to approve Ordinance 06-1202, Rezoning of the Northeast Industrial park, Lots 3, 4, 5, 6 and 7, as presented. Motion was seconded by Commissioner Susan Doerner and carried on a 5 _ 0 vote.
