<br />City Commission Meeting <br />June 26, 2006 <br />Page 13 <br /> <br />to July 14, 2006 to allow time for further consultation with their engineers and time to negotiate with <br />prospective tenants for the planned Casselberry City Center. The extension does not impact the City's <br />closing date for the project which is November 30, 2006. <br /> <br />Staff Recommendation: The Amendment was prepared and approved by the City Attorney and staff <br />recommends approval of Resolution 06-1687. <br /> <br />Audience InDut: John Casselberry, 700 S. Lost Lake Lane, Casselberry, Florida, addressed the <br />Commission regarding utilities and the City's bond ratings. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford to approve Resolution 06-1687, <br />Unicorp Reqnest for Extension of30 days, as presented. Motion was seconded <br />by Commissioner Susan Doerner and carried on a 4 - 0 vote. <br /> <br />K. SPR 05-24 - Legacy Park (Phases I & II), Townhome Redesign and SP 05-04 - Legacy Park <br />Residential Townhome, A Replat <br /> <br />Staff Presentation: This is a request from Centex Homes to revise the townhome component of the <br />residential development within the Legacy Park Planned Development. The townhomes are being reduced <br />from 150 units to 128 units to accommodate a two car garage rather than the original one car garage unit. <br />The buildings will increase to three stories and several dead-end roadways were eliminated. <br /> <br />SPR 05-24, Legacy Park Townhome Redesign and SP 05-04 Legacy Park Residential Townhome Replat <br />were reviewed by the Planning and Zoning Comm ission on May 10,2006 with recommendation for approval <br />with the following conditions: <br /> <br />1) Sheet C-234 of the townhome development plan shall be revised as provided in Exhibit D. <br />2) A performance bond shall be provided to cover the costs of relocating the utility lines prior to <br />issuance of building permits for he townhome units. <br />3) A deed shall be executed to provide the City of Casselberry ownership of the lift station tract prior <br />to issuance of building permits within the townhome development area. <br />4) All conditions of the Public Works Department shall be met prior to issuance of a site construction <br />permit. <br />5) The proposed site development shall occur as presented and approved. All general notes included <br />in the site plan package shall be adhered to and followed by the applicant, the property owner, future <br />owners and their successors and assigns. <br />6) The site plan approval shall be valid for one year upon approval by the City Commission. An <br />extension request must be submitted prior to the expiration of the approval. <br />7) The applicant shall be responsible for all City Surveyor fees, paid to the City of Casselberry, and all <br />recording fees, paid to the Clerk of the Court, piror to the recording of the replat. <br /> <br />Staff Recommendation: Approval ofSPR 05-24, Legacy Park Townhome Redesign and SP 05-04 Legacy <br />Park Residential Townhome Replat as presented. <br />
