First Reading of Ordinance 06-1190 - Commercial Solid Waste Franchise Amendments <br /> <br />The City Clerk read Ordinance 06-1190 by title as follows; <br /> <br />'''AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />CHAPTER 70, SOLID WASTE, TO ADD ARTICLE III, GRANT OF <br />COMMERCIAL SOLID WASTE FRANCHISE; PROVIDING FOR THE <br />GRANTING OF ANON-EXCLUSIVE FRANCHISE TO (Name of Franchise), FOR <br />THE COLLECTION OF COMMERCIAL SOLID WASTE, TO IMPOSE CERTAIN <br />TERMS, CONDITIONS AND REQUIREMENTS RELATING THERETO; <br />PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS, INCLUDING <br />REPEALING ORDINANCE 715, AND AN EFFECTIVE DATE." <br /> <br />Staff Presentation: Ordinance 06-1190 is the result of a survey and comparative analysis that was conducted <br />to compare the method of regulating Commercial Solid Waste Disposal in Casselberry to that of the <br />surrounding cities, which include Maitland and Winter Park. The amendments in the proposed ordinance <br />are comparable to the surrounding cities, i.e charging methodology is based upon the levying of a percentage <br />charge on the gross revenue as opposed to the City's current charging ofa fixed rate of$.75 cubic yard of <br />container capacity. Proposed advantages to Proposed Ordinance 06-1190 are as follows: <br /> <br />. More efficient compliance monitoring and overall consistency of solid waste disposal by <br />assigning one City Department (Public Works) to oversee solid waste collection issues. <br /> <br />Increased revenue for the City; adding the provision for free collection for the City, which <br />should decrease the current expenditure for City solid waste collection. The City Manager <br />stated that the revenue is anticipated to double annually from $140,000 to $288,000. <br /> <br />. Obligation by franchisee to serve the City during incidents of natural disaster <br /> <br />. Improved quality of service to do business within the corporate limits, i.e. advanced <br />notification for holiday delays, accessible operating office, handling complaints more <br />efficiently and providing transitional period for rate increases to newly annexed properties. <br /> <br />. Increase in safe and sanitary practices by franchisees <br /> <br />Additional legal protection for the City <br />
