<br />NOW, THEREFORE, BE IT ENACTED by the City Commission of the <br /> <br />City of Casselberry, Florida, as follows: <br /> <br />SECTION 1. Leaislative and Administrative Findinas. The above <br /> <br />recitals (whereas clauses) are hereby adopted as the legislative and <br /> <br />administrative findings of the City Commission. <br /> <br />SECTION 2. <br /> <br />Subsections e, f, hand j of Section 2-157, Division 2 of <br /> <br />the Code of Ordinances of the City of Casselberry, is hereby amended to read as <br /> <br />follows: <br /> <br />Section 2-157. Application for satisfaction or release of code <br />enforcement liens. <br /> <br />(e) Upon receipt of the application for satisfaction or release of lien and <br />payment provided above, the Fire Chief or designee shall confirm through <br />the Code Enforcement Officer that the violation which resulted in the order <br />imposing penalty or fine has been brought into compliance. If the <br />violator/property owner has been brought into compliance and there is no <br />current code violation upon the property in question, the Fire Chief or <br />designee shall place the application upon the agenda of the next available <br />regularly scheduled meeting of the Code Enforcement Board for the City <br />of Casselberry. <br /> <br />(f) At the hearing before the Code Enforcement Board, the Board shall <br />review and consider the application for satisfaction or release of lien, <br />pre'liee allow the violator/property owner with an opßertunity to address <br />the Board regarding the application for satisfaction or release of lien, and <br />to take the testimony of other interested parties, including but not limited to <br />city staff. Failure of the violator/propertv owner or aqents therefore to <br />appear at the hearinq mav result in a denial of the request for reduction or <br />forqiveness of the lien. <br /> <br />(h) After a recommendation has been rendered by the Code <br />Enforcement Board, the Fire Chief or designee shall place the application <br />for satisfaction or release of lien upon the agenda of the next a future <br />regularly scheduled City Commission meeting. The City Commission may- <br />shall take action solely based upon the sworn application and <br /> <br />Ordinance No. 06-1176 <br />Page 2 of 4 <br />
