Appeal of Planning and Zoning Decision on SPR 05- 18, Edebohis Warehouse, 341 Oleander Way, <br />Casselberry, Florida <br /> <br />This appeal of a Planning and Zoning Decision from Jack Reynolds, Applicant, Edebohis warehouse, 341 <br />Oleander Way, Casselberry, Florida, This appeal is being presented to the Commission according to the rules <br />outlined in Article I, Section 1-2.6)E-H) of the City's Unified Land Development Code. The Planning and <br />Zoning Commission denied the site plan proposal to develop a 1.0 I acre parcel, consisting ofthe construction <br />of an 11,990 sq. ft. building, 15,926 sq. ft. of pavement and a dry retention system. <br /> <br />The City Attorney stated that the appeal to the City Commission shall be limited to certiorari review of the <br />documents, plans, papers or other materials constituting the record and no new information will be received. <br />The rules provide for the appellant to be allowed to make a presentation, then staff presentation and then <br />a rebuttal by the appellant. <br /> <br />Aooellant Presentation: Jack Reynolds, Project Manager, American Civil Engineering Company, 207 <br />Moss Road, Winter Springs, Florida, Also present were the owners ofEdebohis Warehouse. Mr. Reynolds <br />stated that the revised plan and the reason for the modification requested was to provide more landscaping <br />and save trees. He said the Code was inequitable because it calls for tree replacement inch for inch for trees <br />being taken down, but does not give credit inch for inch for trees that he was saving. <br /> <br />Staff Presentation: Ms. Smith stated that the major concern of the Planning and Zoning Commission was <br />with the rear setback. All other concerns of the Planning and Zoning Commission have been met. The <br />applicant is requesting the following site plan modifications. <br /> <br />1) Allow the dumpster enclosure to encroach 8 feet into the required 25-foot setback. <br /> <br />2) Allow the two parking places that are conflicting with the loading zone. <br /> <br />3) Waiver of the contribution required for the tree bank. <br /> <br />Aoolicant Rebuttal: Mr. Reynolds agreed to additional landscaping around the dumpster and also agreed <br />to providing additional landscaping between the project and the residential area. H also agreed to adding <br />Cypress Trees to the retention pond. He will resubmit a landscape plan to staff for review and then bring <br />back to the Commission for consideration. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford to SPR-05-18, approving the <br />ULDR requested modification in Section 3.10; numbers 1,2 and 3; postponing <br />number 4 and submit a new landscaping plan regarding the tree bank; also <br />approve the eight site plan modifications included in the Planning and Zoning <br />Commission Packet dated September 14, 2005. The motion was seconded by <br />Commissioner Susan Doerner and carried unanimously by voice vote. (5 -0) <br />
