<br />RESOLUTION 06-1641 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF A SETTLEMENT AGREEMENT BETWEEN J.M. HATTAWAY AKA. <br />HATTAWAY REALTY AND THE CITY OF CASSELBERRY REGARDING THE <br />REMOVAL OF TWO BILLBOARDS, ONE LOCATED ON STATE ROAD 434 AND A <br />SECOND BILLBOARD LOCATED ON U.S. HIGHWAY 17/92; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry wishes to resolve a dispute between Hattaway Realty <br />and the City of Casselberry; and <br /> <br />WHEREAS, Hattaway Realty and the City of Casselberry have come to a mutually agreed <br />upon resolution of said dispute; and <br /> <br />WHEREAS, the City of Casselberry wishes to eliminate two billboards, one located within <br />the City's Redevelopment District, the other located on State Road 434; and <br /> <br />WHEREAS, it is mutually agreed that the City will compensate Hattaway Realty in the <br />amount of $112,272.50; and <br /> <br />WHEREAS, Hattaway Realty agrees to release all claims resulting out of potential <br />litigation regarding property rights; and <br /> <br />WHEREAS, Hattaway Realty has provided sufficient releases regarding any future use of <br />said sites. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby authorizes the Mayor <br />to execute the settlement agreement (attached as "Exhibit A"). <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
