Section 9. Public Records Law. Each party acknowledges its obligation under Chapter 119, Florida Statutes, to release public records to members of the public upon request. Each party acknowledges it is required to comply with Chapter 119, Florida Statutes, in the handling of the materials created under this Agreement and that the statute controls over the terms of this Agreement. Section 10. Effective Date Term, This Agreement shall become effective upon ful! execution by the parties hereto. Unless otherwise terminated by agreement of the parties, this Agreement shall remain in effect for five (5) years with two (2) one-year optional renewals. Section 11. Indemnification. (a) No party to this Agreement, its officers, employees and agents shall be deemed to assume any liability for the acts, omissions and negligence of the other party, its officers, employees and agents. (b) Each party to this Agreement is responsible for all personal injury and property damage attributable to the neglig611t acts or omissions of that party and the officers, employees, and agents thereof. In addition, each party is entitled to the benefits of the provisions of Section 768.28, Florida Statutes or any other similar Statutes. Section 12. Conflict of Interest, Each party to this Agreement agrees that it will not contract for or accept employment for the performance of any work or services with any individual, business, cOIporation or government unit that would create a conflict of interest in the performance of its obligation pursuant to this Agreement with COUNTY. IN WITNESS WHEREOF, the lawful representative of the parties hereto have executed and affixed their official seals to this Agreement for the purposes herein expressed on the date and year first above written. 5
