That Article II, SEWERS, Section 86-68(d) Septic tank exception, of the City Code of the City of Casselberry, Florida, is hereby revised as follows: (d) Septic tank exception. All sinale familv properties in the service area which are served by septic tank service on May 26, 1994, shall retain the privilege to pay the one time charge per sewer unit served of $450.00 per ERU (in-City) or $563.00 per ERU (outside-City) at any time within one year from the date that sewer service is available at the site as verified and recorded in the office of the City Department of Public Works. All affected property owners will be notified when sewer becomes available and as to the date of beginning of the one year period. Those exercising this privilege shall pay regular sewer availability charges and commodity charges upon the next regular billing cycle after application, and thereafter. Notwithstanding other Sections of this Code, all sin,¡;¡le fami~ properties in the service area shall have until June 2, -W9êOctober 1. 2006, to exercise this privilege~ and ther-oby shall also havo waived tho flow by availability oharge in the interim. SECTION 3 - SEVERABILITY. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION 4 - CODIFICATION. It is the intention of the City Commission of the City of Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinance of the City of Casselberry, Florida; that the Sections of this Ordinance may be renumbered or re-Iettered to accomplish such intention; that the word, "Ordinance" may be changed to "Section," "Article," or other appropriate word. SECTION 5 - CONFLICTS. All Ordinances or parts of Ordinances in oonflict with any of the provisions of this Ordinance are hereby repealed. SECTION 6 - EFFECTIVE DATE. This Ordinance shall become effective October 1,2005.
