<br />RESOLUTION 05·1628 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF A CONTRACT WITH CASSELBERRY INVESTMENT PROPERTIES, <br />L ro. FOR THE PURCHASE OF NINE PARCELS RELATED TO THE RE-ALIGNMENT <br />OF NORTH WINTER PARK DRIVE AND TRIPLET LAKE DRIVE AND MELODY LANE ; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry desires to construct improvements to North Winter <br />Park Drive and the intersection of U.S. Highway 17-92 and Triplet Lake Drive and Melody Lane; <br />and <br /> <br />WHEREAS, the City of Casselberry requires suitable property for construction of the re- <br />aligned roadways and the retention and storage of stormwater associated with the roadway <br />projects; and <br /> <br />WHEREAS, the City of Casselberry has determined that the real properties identified as <br />Parcel Nos. 08-21-30-510-EDOO-008C, 09-21-30-5BP-OBOO-0320, 17-21-30-503-0000-014F, <br />26-20-30-5AR-ODOO-109A, 26-20-30-5AR-ODOO-108F, 08-21-30-5BL-OAOO-021 B, 09-21-30- <br />5BP-OBOO-10AO, 10-21-30-501-0000-0580, and 16-21-30-300-0080-0000 are desirable for <br />these roadway and other City purposes; and <br /> <br />WHEREAS, the City of Casselberry wishes to enter into an agreement to purchase the <br />above identified real properties; and recommends approval. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Vacant <br />Land Contract for the abovementioned parcels between Casselberry Investment Properties, Ltd. <br />(Seller) and the City of Casselberry (Buyer) (attached as "Exhibit A" and authorizes the Mayor to <br />execute said document on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
