<br />RESOLUTION 05-1622 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING <br />THE EXECUTION OF AMENDMENT 1 TO LOAN AGREEMENT CS120561140 <br />BETWEEN THE FLORIDA WATER POLLUTION CONTROL FINANCING <br />CORPORATION AND THE CITY OF CASSELBERRY REVISING THE STATE <br />REVOLVING FUND LOAN AMOUNT AND PAYMENT AMOUNTS TO <br />REFLECT ACTUAL COSTS; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE." <br /> <br />WHEREAS, at its October 22, 2001 meeting, the City Commission approved entering <br />into an agreement for a low interest rate loan from the State Revolving Loan Fund (SRF) to <br />finance the expansion of its reclaimed water distribution system; and <br /> <br />WHEREAS, the actual costs of the design and construction were less than the approved <br />amount of the loan; and <br /> <br />WHEREAS, the financing agency, the Florida Water Pollution Control Financing <br />Corporation, and the City of Casselberry desire to revise the loan amount, and therefore the loan <br />payment amounts to reflect the actual costs, service fees and capitalized interest; and <br /> <br />WHEREAS, the City Attorney has reviewed Amendment 1 and finds it to be in legally <br />acceptable form. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves <br />Amendment 1 to the Clean Water State Revolving Fund Loan Agreement Number CS120561140 <br />(attached hereto as "Attachment A"), and authorizes the Mayor to execute said document on <br />behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
