<br />FILE NUM 2002995130 <br />OR BOOK 04638 PAGE 1716 <br /> <br />correct the violation. The Code Enforcement Officer, upon notifying the <br />violator of a repeat violation, shall notify the Code Enforcement Board and <br />request a hearing. The Code Enforcement Board, through its clerical staff, <br />shall schedule a hearing and shall provide notice pursuant to Section 2-156. <br />The case may be presented to the Code Enforcement Board even if the <br />repeat violation has been corrected priorto the Board hearing, and the notice <br />shall so state. If the repeat violation has been corrected, the Code <br />Enforcement Board retains the right to schedule a hearing to determine costs <br />and impose the payment of reasonable enforcement fees upon the repeat <br />violator. The repeat violator may choose to waive his or her rights to this <br />hearing and pay said costs as determined by the Code Enforcement Board. <br />For purposes of this Section, the term "repeat violation" means a violation of <br />a provision of a code or ordinance by a person ..hom the code enforcement <br />board who has been previously found throuah a code enforcement board or <br />anv other auasi-iudicial or iudicial Drocess. to have violated or who has <br />admitted violatina the same provision within five (5) years Drior to of the <br />violation. notwithstandina the violations occur at different locations. <br /> <br />(d) If the Code Enforcement Officer has reason to believe a <br />violation or the condition causing the violation presents a serious threat to <br />the public health, safety and welfare or if the violation is irreparable or <br />irreversible in nature, the Code Enforcement Officer shall make reasonable <br />effort to notify the violator and may immediately notify the Code Enforcement <br />Board and request a hearing. <br /> <br />~ if the owner of mODertv which is subiect to an enforcement <br />Droceedina before the Code Enforcement Board orcourt transfers ownershiD <br />of the DroDertv between the time the initial Dleadina or notice was served and <br />the time of the hearina. such owner shall: <br /> <br />ill Disclose. in writina. the existence and the nature of the <br />Droceedina to the DrosDective transferee. <br /> <br />~ Deliver to the DrosDective transferee a CODV of the <br />Dleadinas. notices. and other materials relatina to the code enforcement <br />Droceedina received bv the transferor. <br /> <br />~ Disclose. in writina. to the DrosDective transferee that the <br />new owner will be resDonsible for comDliance with the aDDlicable code and <br />with orders issued in the code enforcement Droceedina. <br /> <br />~ File a notice with the code enforcement officer to the <br />transfer of the DroDertv. with the identity and address of the new owner and <br /> <br />Ordinance No. 00-975 <br />Page 2 <br />
