Reischmann <br />Stenstrom, Mcintosh, Colbert et al <br />200 West First Street <br />Sanford, FL 32772-4848 <br /> <br />RESOLUTION NO. 05-1574 <br /> <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />RESOLUTION 94-869 TO PROVIDE A FEE, INCLUDING REIMBURSEMENT FOR <br />STAFF TIME AND ADVERTISING COSTS, FOR APPEALS OF DECISIONS OF THE <br />BOARD OF ADJUSTMENT TO THE CITY COMMISSION, AS PROVIDED IN THE <br />CASSELBERRY CODE OF ORDINANCES PART III, UNIFIED LAND DEVELOPMENT <br />REGULATIONS, ARTICLE II, SECTION 1.2-1(D)(5) AND SECTION 1-2.7(F)(5); <br />PROVIDING FOR CONFLICTS, AND AN EFFECTIVE DATE. <br /> <br />WHEREAS, by City of Casselberry Unified Land Development Regulation 1-2.8, the City <br /> <br />Commission may set fees imposed by the Land Development Regulations by resolution; and <br /> <br />WHEREAS, by Resolution 94-869, the City Commission of the City of Casselberry set fees for <br /> <br />development review; and <br /> <br />WHEREAS, the City Commission has revised Land Development Regulations Section 1-2.1(D)(F) <br /> <br />and Section 1-2.7(F)(5) to provide that appeals from the City's Board of Adjustment shall proceed to the <br /> <br />City Commission rather than the Seminole County Circuit Court; and <br /> <br />WHEREAS, the adopted appeal process requires staff time and public notification costs and the <br /> <br />City Commission has determined that these costs shall be incurred by the appellant; and <br /> <br /> <br />WHEREAS, the City Commission desires to amend Resolution 94-869 to add a fee related to <br /> <br />appeals to the City Commission, and in all other respects the fees set in Resolution 94-869 shall be <br /> <br />unchanged. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA: <br />
