<br />RESOLUTION 03-1405 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING EXECUTION <br />OF CHANGE ORDER NUMBER ONE WITH MCMAHAN CONSTRUCTION CO., INC. TO <br />PROVIDE ADDITIONAL CONSTRUCTION SERVICES FOR THE RECLAIMED WATER PLANT <br />EXPANSION AT THE WATER RECLAMATION FACILITY; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry has entered into an agreement with McMahan Construction <br />Co., Inc. to provide all necessary labor, materials, equipment, tools and services needed for the <br />Reclaimed Water Plant Expansion at the Water Reclamation Facility; and <br /> <br />WHEREAS, during that construction, several additional items of work were required to be <br />performed based on unknown field conditions, and other items of work were no longer required; <br />and <br /> <br />WHEREAS, the City has also budgeted for upgrade of the surge tank pumps to meet the required <br />pumping capacity for the expansion; and <br /> <br />WHEREAS, the City staff and CPH Engineers, Inc. has reviewed the costs for these items as <br />proposed by McMahan Construction Co., Inc. and found them to be reasonable and proper and <br />recommend approval. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry, Florida, hereby accepts the Change <br />Order NO.1 with McMahan Construction Co., Inc., attached as "Exhibit A", and authorizes the <br />Mayor to sign the enclosed change order. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions <br />of this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or <br />effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
