<br />RESOLUTION 05·1606 <br /> <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF A FIRST AMENDMENT TO THE COMMERCIAL LEASE BETWEEN THE <br />CITY OF CASSELBERRY AND LEONARD CASSELBERRY AND RICHARD <br />CASSELBERRY, TRUSTEE, TO EXTEND THE TERM FOR 30 DAYS; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br /> <br />WHEREAS, on September 27, 2004, the City of Casselberry approved the Commercial Lease on the <br />property known as "Tract D" between the City and Leonard Casselberry and Richard S. Casselberry, Trustee, <br />by Resolution No. 04-1531; and <br /> <br />WHEREAS, Leonard and Richard Casselberry have requested a 30 day extension to the Commercial <br />Lease in order to remove personal property remaining on the property; and <br /> <br />WHEREAS, the City Commission hereby finds the First Amendment to Commercial Lease to be in <br />acceptable form. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry approves the First Amendment to <br />Commercial Lease of the land identified as Tract D attached hereto, and authorizes the Mayor to execute the <br />attached First Amendment to Commercial Lease on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of <br />this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of <br />any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
