<br />benefit improvements, either benefits will be prospectively reduced or member contributions shall <br />be increased accordingly; and <br />WHEREAS, the City Commission intends that the funding credit balance as reflected in the <br />actuarial valuation report as of October I, 2004 and future actuarial reports, shall continue to be <br />utilized to offset required City contributions to the pension plan in an amount determined annually <br />by the City, for as long as such credit funding balance exists; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA; <br />SECTION 1: That Chapter 62, Personnel, Article XVIII, Police Officers' and Firefighters' <br />Pension Plan, Sections 62-481 through 62-507, inclusive, of the Code of Ordinances of the City of <br />Casselberry is hereby amended and restated as set forth in the document designated CITY OF <br />CASSELBERRY POLICE OFFICERS' AND FIREFIGHTERS' PENSION PLAN, attached hereto <br />and made a part hereof. <br />SECTION 2: All Ordinances or parts of Ordinances in conflict herewith be and the same <br />are hereby repealed. <br />SECTION 3: If any section, subsection, sentence, clause, phrase of this ordinance, or the <br />particular application thereof shall be held invalid by any court, administrative agency, or other body <br />with appropriate jurisdiction, the remaining section, subsection, sentences, clauses, or phrases under <br />application shall not be affected thereby. <br />That this Ordinance shall become effective ten (10) days after fmal reading <br /> <br /> <br />,2005. <br /> <br />Bo <br />Mayor/Commissio <br /> <br />ATTEST: <br /> <br />~M~~t~ <br />
