<br />RESOLUTION 05-1592 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, TO ENTER INTO A <br />MEMORANDUM OF AGREEMENT WITH THE STATE OF FLORIDA, DEPARTMENT OF <br />AGRICULTURE AND CONSUMER SERVICES, DIVISION OF FORESTRY FOR AN URBAN <br />AND COMMUNITY FORESTRY GRANT. " <br /> <br />WHEREAS, the City Commission has previously been awarded an Urban and Community Forestry Grant for the <br />development of a tree program; and <br /> <br />WHEREAS, the City of Casselberry, through adopted landscaping and tree protection ordinances, site plan <br />reviews and redevelopment, the daily operations of the Public Works and Parks & Recreation Departments, and the <br />dispersal of arbor information to the general public, takes a very proactive role in the establishment and maintenance of <br />trees located within the City; and <br /> <br />WHEREAS, the City has recently suffered significant hurricane damage to the native wetland trees; and <br /> <br />WHEREAS, the City of Casselberry wishes to replant and reforest with native tree species; and <br /> <br />WHEREAS, the City of Casselberry wishes to enter into an Urban and Community Forestry Memorandum of <br />Agreement between the City of Casselberry and the Florida Department of Agriculture and Consumer Services. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission supports the establishment of a tree planting program, and hereby authorizes <br />the Mayor to enter into an Urban and Community Forestry Memorandum of Agreement (attached as Exhibit I) between <br />the City of Casselberry, Florida and the Florida Department of Agriculture and Consumer Affairs. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this <br />Resolution are hereby repealed. <br /> <br />SECTION Ill. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, <br />or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this <br />Resolution. <br /> <br />SECTION IV. Effective Date.
