<br />RESOLUTION 05-1591 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, TO ENTER INTO THE <br />JOINT PLANNING AGREEMENT RELATING TO LANDSCAPE & IRRIGATION <br />INSTALLATION ON A PORTION OF STATE ROAD 15/600 U.S. HIGHWAY 17/92 WITH <br />THE STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION: PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry now maintains the medians on State Road 15/600 U.S. Highway 17/92 and <br />desires to improve the beautification element of the roadway within the corporate limits of the City of Casselberry; and <br /> <br />WHEREAS, the City of Casselberry desires an active role in beautification and maintenance of said medians; <br /> <br />and <br /> <br />WHEREAS, the Florida Department of Transportation has agreed to compensate the City in the amount of <br />$149,500 for median improvements between Piney Ridge Road and Button Road: and <br /> <br />WHEREAS, the City of Casselberry has reviewed the proposed Joint Planning Agreement; and <br /> <br />WHEREAS, it is in the public interest of the residents of the City of Casselberry to have an enhanced <br />appearance of State Road 15/600 U.S. Highway 17/92 within the City. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission authorizes the Mayor to execute the Joint Planning Agreement (attached as <br />Exhibit A) between the Florida Department of Transportation and the City of Casselberry, relating to landscape & <br />irrigation improvements on State Road 15/600 U.S. Highway 17/92 from Piney Ridge Road to Button Road. <br /> <br />SECTION II. The City Commission hereby accepts the terms and conditions as presented in said Agreement. <br /> <br />SECTION III. Conflicts. All Resolutions or patts of Resolutions in conflict with any of the provisions of this <br />Resolution are hereby repealed. <br /> <br />SECTION IV. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, <br />unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section <br />or part of this Resolution. <br /> <br />SECTION V. Effective Date. This Resolution shall become effective immediately upon its passage and <br />adoption. <br /> <br />PASSE. om!
