RESOLUTION 05-1589 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF A LAND SWAP AND CREDIT AGREEMENT WITH C.F.E., LLC RELATIVE TO TWO PARCELS WITHIN THE PROGRESS ENERGY EASEMENT BETWEEN BELLE AVENUE AND HELEN STREET FOR CONSTRUCTION OF THE RE-ALIGNMENT OF NORTH WINTER PARK DRIVE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry desires to construct improvements to North Winter Park Drive; and WHEREAS, C.F.E., LLC owns property in the area required for right-of-way for said re- alignment; and WHEREAS, the City of Casselberry is interested in acquiring a triangular parcel of C.F.E.'s property in exchange for credit toward purchase of an approximate one acre industrial-zoned lot that the City intends to plat; and WHEREAS, the City of Casselberry wishes to enter into an agreement to give to C.F.E., LLC this credit in exchange for the real property; and recommends approval. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Land Swap and Credit Agreement (attached as Exhibit A) and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption. PASSED and ADOPTED this ø£ day of a./A ATTEST: ¿II , AD 2005.
