<br />ORDINANCE 715 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, <br />FLORIDA, PROVIDING FOR THE GRANTING OF A NON- <br />EXCLUSIVE FRANCHISE TO , <br />FOR THE COLLECTION OF COMMERCIAL SOLID WASTE, <br />TO IMPOSE CERTAIN TERMS, CONDITIONS AND <br />REQUIREMENTS RELATING THERETO; PROVIDING <br />SEVERABILITY, CONFLICTS AND AN EFFECTIVE DATE. <br /> <br />BE IT ENACTED BY THE CITY OF CASSELBERRY, FLORIDA AS FOLLOWS; <br /> <br />SECTION ONE: There is hereby granted to <br />(herein called the "Franchisee"), it successors and assigns, a non <br />exclusive right, privilege or franchise to collect garbage, refuse, <br />trash and other solid waste materials from commercial <br />establishments within the City of Casselberry, Seminole County, <br />Florida, during the term and subject to the following limitations <br />and conditions as hereinafter set forth. <br /> <br />1. Definitions. <br /> <br />a. "City" shall mean the City of Casselberry, Florida, <br />a municipal corporation. <br /> <br />b. "Franchisee" shall mean the individual, partnership <br />or corporation who/which agrees, as hereinafter provided to perform <br />the work or service, or to furnish materials or equipment, or both <br />as set forth in this franchise. <br /> <br />c. "Commercial solid waste" shall mean garbage, <br />rubbish, trash, etc., resulting from the normal activities of <br />establishments that are required to obtain an occupational license <br />from the City. <br /> <br />d. "Garbage" shall mean every waste accumulation and <br />animal and vegetable matter which attend the preparation, use, <br />cooking, processing, handling or storage of meats, fish, fowl, <br />frui ts, vegetables or other matter which is subject to <br />decomposition, decay, putrefaction and the generation of offensive <br />and noxious gases or odors, or which during or after decay may <br />serve as breeding or feeding materials from flies, insects or <br />animals. <br /> <br />e. <br />combustibles <br />combustibles <br /> <br />"Commercial rubbish and trash" shall mean <br />as paper, wood, yard tr immings, etc., and <br />such as metal, glass, stone, dirt, etc. <br /> <br />such <br />non- <br /> <br />1 <br />
