Wells, AICP, Community Development Director 95 Triplet Lake Drive Casselberry, FL 32707 ORDINANCE # 04·1142 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATIONS OF HIGH DENSITY RESIDENTIAL (HDR) AND COMMERCIAL (COM) FOR THOSE PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. Whereas, the properties described in Section I were annexed into the City of Casselberry on January 12,2004; and Whereas, a Public Hearing on the question of amending the Seminole County High Density Residential and Commercial future land use designations of the properties hereinafter described, has been duly held in the City of Casselberry, Florida and at such hearing, interested parties and citizens for and/or against the proposed establishment of the City of Casselberry High Density Residential and Commercial future land use designations were heard; and Whereas, the Casselberry Planning and Zoning Commission/Local Planning Agency has held a public hearing with due public notice to consider the comprehensive plan amendment; and Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held a public hearing to consider the comprehensive plan amendment and has determined that the Future Land Use designation of said property shall be established as High Density Residential and Commercial as that designation is defined in Future Land Use Element Policies FLU 1.3 and FLU 1.8, as amended and supplemented, of the Comprehensive Plan of the City of Casselberry, Florida; and Whereas, such amendments are permitted subject to the provisions of F.S. Chapter 163, and FAC Rule 9J-11. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same is hereby amended to include properties as High Density Residential and Commercial, for those parcels of land located at 132 Monarch Circle, 229 Maltese Circle and 555 SR 436 as requested by the owner of said land described as: Ordinance 04-1142 Page 1
