Wells, AICP, Community Development Director 95 Triplet Lake Drive Casselberry, FL 32707 ORDINANCE NO. 04-1144 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND USE MAP BY ESTABLISHING THE FUTURE LAND USE DESIGNATION OF "WESTSIDE OVERLAY DISTRICT" FOR THOSE PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. Whereas, a Public Hearing on the question of establishing a future land use designation of the property hereinafter described has been duly held in the City of Casselberry, Florida and at such hearing, interested parties and citizens for and/or against the proposed establishment of the future land use designation were heard; Whereas, the Casselberry Planning and Zoning Commission/Local Planning Agency has held a public hearing with due public notice to consider the comprehensive plan amendment; Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held a public hearing to consider the comprehensive plan amendment, and Whereas, such amendments are permitted subject to the provisions of Chapter 163, F.S. and Rule 9J-11, FAC. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That Chapter 66, Section 66·29 of the City of Casselberry Code, as amended and supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, regulating and restricting the use of lands located within the City of Casselberry, Florida, is hereby amended by this amendment to include property as the Wests ide Overlay District of said land described in Exhibit A, and is hereby amended and given the Westside Overlay District Future Land Use designation. SECTION II. Conflicts. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION IV. Effective Date. The effective date of this plan amendment shall be the date a final order is issued by the Department of Community Affairs or Administration Commission finding the amendment in compliance in accordance with Section 163.3184(1)(b), Florida Statutes, Ordinance No. 04-1144 Page 1 of 2
