Wells, AICP, <br />Community Development Director <br />95 Triplet Lake Drive <br />Casselberry, FL 32707 <br /> <br />ORDINANCE NO. 04-1144 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE <br />CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE <br />OFFICIAL FUTURE LAND USE MAP BY ESTABLISHING THE FUTURE LAND <br />USE DESIGNATION OF "WESTSIDE OVERLAY DISTRICT" FOR THOSE <br />PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br /> <br />Whereas, a Public Hearing on the question of establishing a future land use designation of <br />the property hereinafter described has been duly held in the City of Casselberry, Florida and at <br />such hearing, interested parties and citizens for and/or against the proposed establishment of the <br />future land use designation were heard; <br /> <br />Whereas, the Casselberry Planning and Zoning Commission/Local Planning Agency has held <br />a public hearing with due public notice to consider the comprehensive plan amendment; <br /> <br />Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, <br />has held a public hearing to consider the comprehensive plan amendment, and <br /> <br />Whereas, such amendments are permitted subject to the provisions of Chapter 163, F.S. and <br />Rule 9J-11, FAC. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66·29 of the City of Casselberry Code, as amended <br />and supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, <br />Florida, regulating and restricting the use of lands located within the City of Casselberry, Florida, is <br />hereby amended by this amendment to include property as the Wests ide Overlay District of said <br />land described in Exhibit A, and is hereby amended and given the Westside Overlay District Future <br />Land Use designation. <br /> <br />SECTION II. Conflicts. All Ordinances or parts of Ordinances in conflict with any of the <br />provisions of this Ordinance are hereby repealed. <br /> <br />SECTION III. Severability. If any Section or portion of a Section of this Ordinance proves to <br />be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, <br />or effect of any other Section or part of this Ordinance. <br /> <br />SECTION IV. Effective Date. The effective date of this plan amendment shall be the date a <br />final order is issued by the Department of Community Affairs or Administration Commission finding <br />the amendment in compliance in accordance with Section 163.3184(1)(b), Florida Statutes, <br /> <br />Ordinance No. 04-1144 <br />Page 1 of 2 <br />
