<br />CASSELBERRY CITY COMMISSION <br />Minutes of November 22, 2004 - Regular Meeting <br />Page 4 of 14 <br /> <br />Staff Presentation: Mr. Wells stated Resolution 04-1539 provides for the City to establish a non-ad valorem <br />special assessment district to assess affected property owners for maintenance of the Summerset North <br />subdivision wall that is scheduled to be constructed along the Red Bug Lake Road right-of-way. The <br />assessment will provide continued maintenance and repair over the lifetime of the wall. If approved, the <br />maintenance assessment will become effective during the October 2005 fiscal year. Staff recommended <br />approval of Resolution 04-1539 as presented. <br /> <br />MOTION: <br /> <br />Commissioner Doerner moved to approve Resolution <br />04-1539 as presented. Motion was seconded by Vice <br />Mayor Hart. Motion carried unanimously by voice <br />vote. <br /> <br />2. PUBLIC HEARING - FIRST READING OF ORDINANCE 04-1150 - REVISIONS <br />TO THE CITY CODE. CHAPTER 10. ALCOHOLIC BEVERAGES AND <br />DISTANCE SEP ARA TrONS FOR ALCOHOLIC BEVERAGE SALES <br /> <br />The City Clerk read Ordinance 04-1150 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />SELECTED SECTIONS OF THE CITY CODE OF ORDINANCES, INCLUDING PART <br />II, SEC. 10-7, SALE NEAR CHURCHES AND SCHOOLS, TO CREATE DISTANCE <br />SEPARATIONS BETWEEN BARS, LOUNGES, AND BOTTLE CLUBS AND <br />ESTABLISH AN EXEMPTION FOR RETAIL SALES AND NOT FOR ON-SITE <br />CONSUMPTION SALES OF ALCOHOLIC BEVERAGES; AND PART Ill, UNIFIED <br />LAND DEVELOPMENT REQUIREMENTS, SECTION 5-21.2 DEFINITIONS, TO <br />AMEND THE DEFINITIONS OF "BAR ORLOUNGES,""CHURCH OR OTHER PLACE <br />OF WORSHIP," AND "EDUCATIONAL INSTITUTION", AND ADDING A NEW <br />DEFINITION FOR AN "EDUCATIONAL FACILITY"; PROVIDING FOR <br />SEVERABILITY, CODIFICATION, CONFLICTS, AND EFFECTIVE DATE." <br /> <br />Legal Advertisement: The Notice of Public Hearing relative to Ordinance 04-1150 was published in the <br />Orlando Sentinel on November II, 2004. <br /> <br />Public Hearing: Mrs. McPherson stated she received three audience comment request forms for Ordinance <br />04-1150. The following individuals came forward: <br /> <br />I) Charlene Glancy, 210 NE Triplet Drive, spoke in favor of Ordinance 04-1150. <br /> <br />2) Kathy Hale, 325 Southcot Drive, spoke in favor of Ordinance 04-1150. <br /> <br />3) John Casselberry, 700 South Lost Lake Lane, spoke in opposition of Ordinance 04-1150. <br /> <br />Mayor Goff asked if there was anyone in the audience that wished to speak either for or against Ordinance <br />04-1150. No one came forward. Mayor Goff closed the public hearing. <br />
