Wells, AICP, <br />Community Development Director <br />95 Triplet Lake Drive <br />Casselberry, FL 32707 <br /> <br />ORDINANCE # 04-1139 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE <br />CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE <br />OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE <br />DESIGNATION OF INDUSTRIAL (IND) FOR THOSE PARCELS DESCRIBED IN <br />SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND AN EFFECTIVE DATE. <br /> <br />Whereas, the properties described in Section I were annexed into the City of Casselberry on May 24, <br />2004; and <br /> <br />Whereas, a Public Hearing on the question of amending the Seminole County Low Density <br />Residential future land use designation of the properties hereinafter described, has been duly held in the <br />City of Casselberry, Florida and at such hearing, interested parties and citizens for and/or against the <br />proposed establishment of the City of Casselberry Industrial future land use designation were heard; and <br /> <br />Whereas, the Casselberry Planning and Zoning Commission/Local Planning Agency has held a public <br />hearing with due public notice to consider the comprehensive plan amendment; and <br /> <br />Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has held <br />a public hearing to consider the comprehensive plan amendment and has determined that the Future Land <br />Use designation of said properties shall be established as Industrial as that designation is defined in Future <br />Land Use Element Policies FLU 1.9, as amended and supplemented, of the Comprehensive Plan of the <br />City of Casselberry, Florida; and <br /> <br />Whereas, such amendments are permitted subject to the provisions of F.S. Chapter 163, and FAC <br />Rule 9J-11. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Chapter 66, Section 66-29 of the City of Casselberry Code, as amended and <br />supplemented, said Chapter adopting the Comprehensive Plan of the City of Casselberry, Florida, <br />regulating and restricting the use of lands located within the City of Casselberry, Florida, be, and the same <br />is hereby amended to include properties as Industrial, for those parcels of land iocated at Concord Drive, <br />Anchor Road and Oleander Way, as requested by the owner of said lands described as: <br /> <br />Ordinance 04-1139 <br />Page 1 <br />
